Annex 2 - Conditions consistent with the Operating Schedule
1 All licensable activities will be permitted from the end of permitted hours on New Year's Eve to the start of permitted hours on New Year's Day.
2 The terminal hour for all licensable activities is to be extended by one hour every:
Friday, Saturday, Sunday and Monday of each Easter Bank Holiday, May Bank Holiday, Spring Bank Holiday and August Bank Holiday weekend.
Valentines Night, Christmas Eve, Boxing Day and the morning British Summer Time commences.
3 The primary purpose of the premises will be that of a cafe/ bistro/restaurant serving food, with additional use for pre-arranged events and functions. The sale of alcohol will be ancillary to these uses.
4 The provision of food, including full meals and snacks, will form a substantial element of the operation of the premises with sufficient furniture and seating provided and set out in such a way that it does not become a high volume, vertical drinking establishment.
5 Unless persons are attending a pre-arranged private function, ticketed event where admission is only permitted by ticket purchased in advance, or are diners awaiting a booked table, intoxicating liquor will only be supplied for consumption on the premises by persons seated at tables or seated at the bar.
6 Temporary and / or permanent barriers will be used to control access to and egress from the external terrace areas surrounding the building. Until 19.00hrs these will be positioned on the perimeter of the premises (as defined by the red line on the plan attached to this licence). After 19.00hrs ropes or other temporary barriers will be used to enclose the terraced area adjacent to the building on the seaward side so that access to the terrace is via the building. Suitable signs will be displayed on the terraced areas to indicate that they are for customers only.
7 Premises Licence Holder and the DPS shall ensure that the maximum number of persons allowed inside the premises shall not exceed the capacity determined by the Lancashire Fire and Rescue Service.
8 Seating inside the premises will be provided for at least 80% of the total maximum capacity of that part of the premises as determined by a risk assessment and agreed with the Fire & Rescue Service.
9 Whenever licensable activities are available at the premises a waiter/waitress service shall be available.
10 Except for pre-arranged private functions and ticketed events where admission is only permitted by ticket purchased in advance, groups wearing fancy dress will not be allowed admittance to the premises.
11 Except for pre-arranged private functions and ticketed events where admission is only permitted by ticket purchased in advance, no customers will be admitted to the premises after 00.30hrs on any day.
12 All pint glasses, used at the premises, will be made of toughened glass or polycarbonate.
13 At least one personal licence holder will be contactable while the supply or sale of alcohol is being undertaken (whose identity will be known to all other staff engaged in the supply or sale of alcohol) except in the case of emergency.
14 Another member of staff shall be nominated to act for the Designated Premises Supervisor, in their absence, whose identity is known by all other staff when such absence occurs.
15 An authorisation of sales, signed and dated by the DPS, shall be kept at the premises showing all persons authorised by them to make sales of alcohol at the premises. All staff involved in sales will be at least 18 years of age and will receive training to promote the licensing objectives. All training to be documented and records made available on request to Lancashire Police or any authorised officer.
16 The Designated Premises Supervisor or a nominated representative shall be a member of the Pub Watch Scheme for the area (when such a scheme is in existence) and shall regularly attend the meetings.
17 CCTV will be installed internally and externally at the premises and will comply with the following:
i. The CCTV system shall be installed, maintained and operated to the reasonable satisfaction of Lancashire Constabulary. All public areas of the premises are to be covered by the system. The system will incorporate a camera covering each of the entrance doors and will be capable of providing an image which is regarded as identification standard.
ii. The system will display on any recording the correct time and date of the recording.
iii. The system will make recordings during all hours the premises are open to the public.
iv. VCR tapes or digital recording shall be held for a minimum of 31 days and 28 days respectively after the recording is made and will be made available to the Police or any authorised persons acting for Responsible Authority for inspection upon request.
v. The system will, as a minimum, record images of the head and shoulders of all persons entering the premises.
18 A staff member who is conversant with the operation of the CCTV system will be on the premises at all times the premises are open to the public. This staff member will be able to show recent data or footage with the absolute minimum of delay when requested to by a Police Officer.
19 The Licence Holder or Designated Premises Supervisor shall notify the Police Licensing Unit on any occasion when the CCTV is to be inoperative for a period in excess of one working day and shall provide a certificate from a competent person stating the reason for the system being inoperative and the measures which have been taken to satisfy the licence conditions.
20 Bi-annually documented maintenance checks of the CCTV system, including the recording system will be undertaken by the Designated Premises Supervisor to ensure that the system is in good working order and fit for purpose.
21 Appropriate signage alerting customers to CCTV recording shall be displayed in conspicuous positions on the premises.
22 A zero tolerance drugs policy will be adopted at the premises.
23 Security/staff arrangements will be sufficient to discourage the sale and consumption of drugs and shall ensure such arrangements include regular checks of toilet areas.
24 Records of incidents involving the use and / or detection of drugs shall be maintained and those records shall be available for inspection.
25 Confiscated/ found drugs shall be stored in a safe and recorded in an incident book. The police will be informed and collection arranged.
26 Where there is reasonable suspicion that drugs are being carried, the licensee shall ensure that the outer clothing, pockets and bags of those entering the venue are searched by a trained staff member of the same sex.
27 Clearly visible notices, in a form prescribed by the Council, shall be displayed advising those attending that:
a) It is a condition of entry that customers agree to be searched and
b) Police will be informed if anyone is found in possession of controlled substances or weapons.
28 Frequent collection of glasses and bottles will be undertaken to ensure that empty containers do not accumulate in or around the licensed premises.
29 No person in possession of a drink in a sealed or unsealed container will be allowed to enter the premises except for the purposes of delivery.
30 No off sales from the premises shall be permitted save for unfinished bottles of wine which must be re-corked before being taken away from the premises.
31 Suitable beverages other than intoxicating liquor (including drinking water) shall be equally available for consumption, with or otherwise as an ancillary to, food served in the licensed premises.
32 The premises licence holder will risk assess the requirement for door supervisors at the premises and shall employ door supervisors in such numbers and at such times as is deemed necessary by the risk assessment. This requirement to provide door supervisors as determined by risk assessment will equally apply in respect of private functions and ticketed events where admission is only permitted by ticket purchased in advance.
33 Notwithstanding the above requirement to provide door supervisors as determined by risk assessment, at least one door supervisor should be employed on Friday and Saturday evenings from 22.00 hours until closing.
34 An incident book will be maintained in which shall be recorded:-
a. All incidents of crime and disorder
b. Refused sales to suspected under-age and drunken persons
c. A record of any person asked to leave the premises or removed from the premises
d. Details of occasions on which the police are called to the premises
e. A record of persons searched on suspicion that drugs are being carried and the reason for such suspicion
The book will be available for inspection by a police officer.
35 Any risk assessments carried out by or on behalf of the Licence holder, which relate to a licensing objective shall be available for inspection by an officer of a Responsible Authority.
36 The volume of amplified sound used in connection with entertainment shall at all times be under the control of the management and the controlling mechanism shall be operated from a part of the premises inaccessible to the public.
37 No speakers shall be sited outside of the premises.
38 No nuisance will be caused by noise coming from the premises or vibration transmitted through the structure of the premises.
39 Except for pre-arranged private functions and ticketed events, levels of music will be reduced to background level from 02.00hrs to encourage a gradual dispersal of customers from the premises.
40 The departure of customers from the premises shall be effectively managed by staff who will request patrons to leave quietly and to avoid causing noise, nuisance or disturbance in the area.
41 The grounds around the premises will be kept clean, tidy and free from debris and cigarette butts.
42 Suitable containers shall be provided for the storage of waste, which are constructed and maintained to prevent the removal of such waste by vandals, thieves, animals, accidental spillage or inclement weather. This shall include any external receptacles provided for the disposal of all discarded smoking related litter, so as to prevent waste litter being deposited onto the highway.
43 There will be placed at all exits from the premises, in a place where they can be seen and easily read by patrons, clear and legible notices requiring customers to leave the premises and the area quietly so as to minimise disturbance in the vicinity.
44 Any external light source associated with the premises shall not cause a nuisance or disturbance to any property within close proximity.
45 A Challenge 25 proof of age policy shall be implemented and adhered to. All staff to have received suitable training in relation to the Challenge 25 proof of age scheme. Records to evidence this will be made available to an authorised officer upon request.
Any person who looks or appears to be under the age of 25 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification acceptable:
i. A recognised proof of age card accredited under the British Retail Consortium's Proof of Age Standards Scheme (PASS)
ii. Photo driving licence
iii. Citizen card supported by the Home Office
iv. Official ID card issued by HM Forces or European Union bearing a photograph and date of birth of the holder.
If no suitable identification is provided, the sale of alcohol to them will be refused.
Suitable signage will be displayed to specify that a Challenge 25 Policy is in place.
46 A notice will be displayed in the premises where it can be clearly seen and read indicating that it is unlawful for persons under 18 to purchase alcohol or for any person to purchase alcohol on behalf of a person under 18 years of age.
47 All staff shall receive suitable training in relation to the proof of age scheme to be applied upon the premises. Records to evidence this will be made available to an authorised officer upon request.
48 Children will not be allowed at the bar serving area.
49 Except for pre-arranged private functions and ticketed events, no children under 14 years of age shall be allowed in the premises after 21.00hrs.
50 No entertainment of an adult nature will take place on the premises.
51 No boxing machines are to be in operation in the premises.
