Annex 2 - Conditions consistent with the Operating Schedule
1. The Licence Holder or Designated Premises Supervisor will be available on site at all times during which the bar is open.
2. No sale of alcohol will take place without the presence of either the DPS or a person nominated by the DPS. When not in use or no nominated person present, the bar area will be secured.
3. When Christmas Eve, Christmas Day, Boxing Day and New Year's Eve fall into midweek (Monday to Friday), permitted hours for supply of alcohol shall be 12.00 to 02.00 hours the following morning.
4. The Licence holder and/or DPS are to support and rigorously enforce the Challenge 25 proof of age policy.
Any person who looks or appears to be under the age of 25 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification acceptable:
i. UK photo driving licence
ii. Passport
iii. Proof of Age Standards Scheme Card
iv. OR any other nationally or locally approved form of identification which may be introduced in the future
5. No persons under the age of 18 years old will be permitted in the bar / sun lounge area unless accompanied by an adult.
6. At least one personal licence holder will be available while the supply or sale of alcohol is being undertaken (whose identity will be known to all other staff engaged in the supply or sale of alcohol) except in the case of emergency.
7. Appropriate measures will be taken to ensure staff prevent the removal of bottles or glasses from the curtilage and grounds of the licensed premises.
8. Sufficient bins and signage will be placed in the front and rear garden areas to ensure that the area is kept clean, tidy and safe at all times.
9. CCTV must be installed internally and externally at the premises and must comply with the following:
i) The CCTV system must be installed, maintained and operated to the reasonable satisfaction of Lancashire Constabulary. All public areas of the premises and any outside areas must be covered by the system. The system will incorporate a camera covering each of the main entrance doors and each camera must be capable of providing an image which is regarded as identification standard in all lighting conditions.
ii) The system must record all hours that the premises are open to the public.
iii) Recordings must display the correct date and time.
iv) Digital recordings must be held for a minimum period of 28 days
v) The system must as a minimum record images of the head and shoulders of all persons entering the premises.
vi) Appropriate signage alerting customers to CCTV recording must be displayed in conspicuous positions on the premises.
A staff member who is conversant with the operation of the CCTV system will be on the premises at all times the premises are open to the public. This staff member will be able to show police recent data or footage with the absolute minimum of delay when requested. Footage must be reproduced and downloaded into a removal format on request of a police officer or authorised officer.
10. The licence holder must notify the Police Licensing Unit on any occasion when the CCTV is to be inoperative for a period in excess of one working day and shall provide a certificate from a competent person stating the reason for the system being inoperative and the measures which have been taken to satisfy the conditions of this licence.
11. All non-residents must leave the premises by midnight each night. A staff member must be able to produce a list of residents to a Police Officer or authorised officer on request.
12. Any residents or friends found to be intoxicated and behaving in a disorderly manner will be ordered to leave the bar area immediately.
13. At all times the licence holder will determine an appropriate number of door staff, having regard to a risk assessment maintained by the premises licence holder. The document must be available for inspection by a police officer or authorised officer if required.
14. All staff who are involved in the sale of alcohol will be trained in relation to the licensing objectives to reduce crime and disorder, promote public safety, prevent public nuisance, and promote the protection of children from harm. Said training will be documented and will be made available to a police officer or an authorised officer upon request.
15. An incident book will be maintained in which will be recorded:
a) All incidents of crime and disorder.
b) Refused sales to suspected underage and drunken persons.
c) A record of any person asked to leave the premises or that are removed from the premises.
d) Details of occasions on which the police are called to the premises.
e) A record of persons searched on suspicion that drugs are being carried and their reason for such suspicion.
The book will be available for inspection by a police officer or authorised officer upon request.
16. Frequent collection of glasses and bottles will be undertaken to ensure that empty containers do not accumulate in or around licensed premises.
17. An authorisation of sales, signed and dated by the DPS, shall be kept at the premises showing all persons authorised by them to make sales of alcohol at the premises.
18. Photographic ID requests to prevent underage drinking.
19. Sufficient bins and signage will be placed in the front and rear garden areas to ensure that the area is kept clean, tidy, and safe at all times.
21. Sufficient lighting internally & externally
22. Regular fire checks & servicing of fire detection & extinguishing equipment will be carried out
23. Designated smoking areas at the front and rear of property. No smoking or vaping indoors.
24. We will implement measures to control noise levels within and around our premises. Additionally, we will have staff to monitor noise levels and address any disturbances promptly.
25. Communication with Neighbours: We will provide them with contact information to reach us directly in case of any noise complaints. This proactive approach will allow us to address concerns swiftly and work collaboratively to find solutions.
26. Closing Time Procedures: As part of our commitment to reducing disturbance, we will ensure that closing procedures are conducted efficiently and quietly. This includes minimising noise during the cleaning and tidying process at the end of the night.
27. Outdoor Area Management: For our outdoor smoking areas, we will have designated staff to monitor noise levels and ensure that patrons are respectful of the surrounding neighbourhood. Additionally, sufficient bins and signage will be placed to encourage proper disposal of waste, reducing any potential for public nuisance.
28. Strict Age Verification: We will implement stringent age verification procedures to ensure that no person under the legal drinking age is served alcohol. This includes requiring valid identification for all patrons who appear to be under 25 years old.
29. Prohibition of Unaccompanied Minors: We will strictly enforce a policy that prohibits unaccompanied minors from entering the premises. This will be clearly communicated through signage and verbal notices to ensure compliance.
