Annex 2 - Conditions consistent with the Operating Schedule
1 During the eve of statutory Bank Holidays, Christmas Eve and New Year's Eve, an additional 30 minutes are permitted on the terminal hour for the sale of alcohol, late night refreshment and the premises opening hours.
2 Customers are encouraged not to gather at the front of the premises.
3 A clear, legible and conspicuous notice requesting patrons to avoid causing nuisance or disturbance to local residents shall be displayed at every exit.
4 All external smoking areas provided for the premises shall be located in such a position that their use does not cause a nuisance to any nearby sensitive premises.
5 The premises licence holder shall provide suitable containers for the storage of waste which are constructed and maintained to prevent the removal of such waste by vandals, thieves, animals, accidental spillage or inclement weather. This shall include any external waste receptacles provided for the disposal of all smoking related litter so as to prevent waste litter being deposited on to the highway.
6 The placing of refuse such as bottles into receptacles outside the premises shall only take place between 09:00 and 20:00 hours so as to prevent disturbance to nearby premises.
7 The Licence holder and / or DPS is to support and rigorously enforce the Challenge 25 proof of age policy.
Any person who looks or appears to be under the age of 25 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification acceptable:
i. UK photo driving licence
ii. Passport
iii. Proof of Age Standards Scheme Card
OR any other nationally or locally approved form of identification which may be introduced in the future.
8 Staff involved in the supply of alcohol will be appropriately trained and records maintained and available upon request. Appropriate training logs will be updated and a refusals book and the Challenge 25 scheme will be initiated.
9 Appropriate measures will be taken to ensure staff prevents the removal of bottles or glasses from the curtilage and grounds of the licensed premises unless in a sealed container and purchased along with a substantial meal.
10 Another member of staff shall be nominated to act for the Designated Premises Supervisor, in their absence, whose identity is known by all other staff when such absence occurs.
11 At least one personal licence holder will be available while the supply or sale of alcohol is being undertaken (whose identity will be known to all other staff engaged in the supply or sale of alcohol) except in the case of emergency.
12 CCTV will be installed internally at the premises and will comply with the following:
a) The CCTV system shall be installed, maintained and operated to the reasonable satisfaction of Lancashire Constabulary. The entrance, bar area and all public areas are to be covered by the system. The system will incorporate a camera covering each of the entrance doors and will be capable of providing an image which is regarded as identification standard.
b) The system will display on any recording the correct time and date of the recording.
c) The system will make recordings during all hours the premises are open to the public.
d) VCR tapes or digital recording shall be held for a minimum of 31 days and 21 days respectively, after the recording is made and will be made available to the Police or any authorised persons acting for Responsible Authority for inspection upon request.
e) The system will, as a minimum, record images of the head and shoulders of all persons entering the premises.
13 A staff member who is conversant with the operation of the CCTV system will be on the premises at all times that the premises is open to the public. This staff member will be able to show police recent data or footage with the absolute minimum of delay when requested. This data or footage playback should be almost instantaneous, with subsequent copies of footage to be made available within 7 days if requested.
14 Appropriate signage alerting customers to CCTV recording shall be displayed in conspicuous positions on the premises.
15 Bi-annual documented maintenance checks of the CCTV system, including the recording system will be undertaken by the Designated Premises Supervisor to ensure that the system is in good working order and fit for purpose.
16 No drinks to be consumed in outside area.
17 An incident book will be maintained, in which shall be recorded: (i) All incidents of crime and disorder (ii) Refused sales to suspected under age / drunken persons (iii) A record of any person asked to leave the premises (iv) Details of occasions upon which the Police are called to the premises (v) The use or discovery of drugs.
18 No entertainment of an adult nature will take place on the premises.
19 Alcohol will only be served when accompanied by food. Meals and substantial refreshments are to be available at all times.
20 A clear sign to indicate that alcohol can only be purchased with hot food for consumption on or off the premises will be displayed at the premises.
21 Any person under the age of 18 admitted to the premises will be accompanied by an adult at all times.
22 No children shall be allowed in the premises after 22:30 hours.
23 Only toughened glasses or polycarbonate vessels will be used at the premises.
24 Frequent collection of glasses and bottles will be undertaken to ensure that empty containers do not accumulate in or around the licensed premises.
25 Alcohol can be purchased through the delivery service via telephone. The customer will be informed that they must be over the age of 18 years old and the driver will ask for proof of age if in doubt using the Challenge 25 scheme. No alcohol will be sold if age cannot be proved.
26 The retail of alcohol may not take place at the delivery site (i.e. any customer's home address). Alcohol may only be provided to customers when payment is made in the licensed premises, either by way of cash payment in person on the premises, or when the customer is not present, card payments can be made with details being taken over the telephone prior to the delivery of the alcohol. This includes the provision of 'free' alcohol on promotional deals where the alcohol is subject to a set amount of food being purchased, or any other such offers which involve the provision of alcohol to encourage hot food sales.
27 The supply of intoxicating liquor for consumption on the premises shall be by waiter / waitress service only and only to persons seated at tables or seated at the bar. Bar service is permitted only to persons attending pre-arranged private functions.
28 Suitable beverages other than intoxicating liquor (including drinking water) shall be equally available for consumption, with or otherwise as an ancillary to, food served in the licensed premises.
29 Risk assessments carried out by or on behalf of the Licence holder which relate to a licensing objective will be available for inspection by an officer or a Responsible Authority.
30 A zero tolerance drugs policy will be adopted at the premises.
31 Security/staff arrangements are sufficient to discourage the sale and consumption of drugs and shall ensure such arrangements include regular checks of toilet areas.
32 Records of incidents involving the use and / or detection of drugs shall be maintained and those records shall be available for inspection.
33 Confiscated/ found drugs shall be stored in a safe and recorded in an incident book. The police will be informed and collection arranged.
