Annex 2 - Conditions consistent with the Operating Schedule
1 This licence shall not take effect until the licence for 113/115 Lytham Road has been surrendered and the time period for that licence to be reinstated by way of transfer has expired with no transfer application being received.
2 Dividing walls are to be built as necessary to ensure that 119 Lytham Road becomes one self-contained unit to prevent the shop being expanded into adjoining addresses.
3 All staff to undertake brief intervention training offered by the Public Health team within six months of the grant of this licence. All new staff to undergo such training, if available within six months of appointment.
4 Alcohol shall form no more than 15% of the display area at any one time.
5 CCTV will be installed internally and externally at the premises and will comply with the following:
The CCTV system shall be installed, maintained and operated to the reasonable satisfaction of Lancashire Constabulary. All public areas of the premises are to be covered by the system.
The system will incorporate a camera covering each of the entrance doors and will be capable of providing an image which is regarded as identification standard.
The system will display on any recording the correct time and date of the recording.
The system will make recordings during all hours the premises are open to the public.
VCR tapes or digital recording shall be held for a minimum of 31 days and 28 days respectively after the recording is made and will be made available to the Police or any authorised persons acting for a Responsible Authority for inspection upon request.
The system will, as a minimum record images of the head and shoulders of all persons entering the premises.
6 A staff member who is conversant with the operation of the CCTV system will be on the premises at all times the premises are open to the public. This staff member will be able to show recent data or footage with the absolute minimum of delay when requested to a Police Officer or to a Local Authority Enforcement Officer.
7 The Licence Holder or Designated Premises Supervisor shall notify the Police Licensing Unit on any occasion when the CCTV is to be inoperative for a period in excess of one working day and shall provide a certificate from a competent person stating the reason for the system being inoperative and the measures which have been taken to satisfy the licence conditions.
8 Appropriate signage alerting customers to CCTV recording shall be displayed in conspicuous positions on the premises.
9 Bi-annually documented maintenance checks of the CCTV system, including the recording system will be undertaken by the Designated Premises Supervisor to ensure that the system is in good working order and fit for purpose.
10 A personal licence holder will be on duty at all times while the sale and supply of alcohol takes place.
11 The licence holder shall erect and maintain a sufficient number of signs at and in the vicinity of alcohol sales points informing customers that sales will not be made to persons under 18 years of age.
12 An incident book will be maintained, in which shall be recorded:
a. All incidents of crime and disorder
b. Refused sales to suspected under age / drunken persons
c. A record of any person refused admission or asked to leave the premises
d. Details of occasions upon which the Police are called to the premises
That book shall be available for inspection by a Police Officer or authorised officer of a responsible authority.
13 A clear, legible and conspicuous notice requesting patrons to avoid causing noise, nuisance or disturbance to local residents shall be displayed at every exit.
14 The licence holder is to support and rigorously enforce the Challenge 25 proof of age policy.
Any person who looks or appears to be under the age of 25 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification acceptable:
i. UK photo driving licence
ii. Passport
iii. Proof of Age Standards Scheme card.
If no suitable identification is provided sale of alcohol to them will be refused. Signs promoting this policy will be prominently displayed at public entrances and alcohol sales areas.
15 All staff to have received suitable training in relation to the Proof of Age Scheme to be applied upon the premises. Records to evidence this will be made available to an authorised officer upon request. Staff will be trained on appointment and every 3 months thereafter.
16 An authorisation of sales, signed and dated by the DPS shall be kept at the premises showing all persons authorised by them to make sales of alcohol at the premises. All staff involved in sales will be at least 18 years of age and will receive training to promote the licensing objectives. All training to be documented and records made available on request to Lancashire Police or any authorised officer
17 Only people over the age of 18 will be allowed to make sales of alcohol to the public.
18 No alcohol shall be sold in single cans, with the exception of occasional items that are sold because their original packaging has been damaged.
19 No beer or cider may be sold with an ABV above 5.5% except premium imported beer and lager which may be no higher than 6.5% ABV.
20 A record must be kept on the premises of every person employed at the premises. The record must contain the following information:
a) Name
b) Personal licence number if they have one.
c) Time duty commenced and time duty terminated
These records must be made available for inspection upon demand by a Police officer, responsible authority or authorised person.
21 Whenever the DPS is not at the premises they will ensure that the premises will be managed by a suitably responsible person.
