Annex 2 - Conditions consistent with the Operating Schedule
1. The premises are operated in accordance with the principles outlined by the ‘Nightsafe’ Scheme, as are relevant to those premises, and indicated in the associated leaflet.
2. The premises shall be operated in participation with the ‘Pubwatch’ and ‘Radiolink’ schemes.
3. The Radiolink equipment will be ‘live’ and will be monitored by the Head Doorman or another responsible person while the licensed premises are open for business.
4. All staff to have received suitable training in relation to the proof of age scheme to be applied upon the premises. Records to evidence this will be made available to an authorised officer upon request.
5. An adequate number of Licensed door supervisors will be on duty as appropriate to any risk assessment and in accordance with the guidance under the ‘Nightsafe’ Scheme.
6. All door staff employed at the entrance / exit of the licensed premises will wear a reflective jacket/tabard of a design approved by the Lancashire Constabulary.
7. Any person exercising a security activity will be employed at the premises at the discretion of the Designated Premises Supervisor or holder of the Premises Licence.
8. Any person exercising a security activity at the premises will clearly display his name badge at all times whilst on duty.
9. Appropriate measures will be taken to ensure staff prevent the removal of bottles or glasses from the curtilage and grounds of the licensed premises. The Licence holder and the Designated Premises Supervisor shall erect and maintain signage on or adjacent to all exits advising patrons of the Street Drinking Order and the intention of staff to enforce a no exit with a bottle policy.
10. Frequent collection of glasses and bottles will be undertaken to ensure that empty containers do not accumulate in or around the licensed premises.
11. Only toughened glass vessels are used to dispense beer to customers.
12. No customers apparently carrying open bottles upon entry shall be admitted to the premises at any times the premises are open to the public.
13. Alcoholic and other drinks may not be removed from the premises in open containers save for consumption in any external area provided for that purpose.
14. At least one personal licence holder will be available while the supply or sale of alcohol is being undertaken (who’s identity will be known to all other staff engaged in the supply or sale of alcohol) except in the case of emergency.
15. Another member of staff shall be nominated to act for the Designated Premises Supervisor, in their absence, whose identity is known by all other staff when such absence occurs.
16. Risk assessments carried out by or on behalf of the Licence holder which relate to a licensing objective will be available for inspection by an officer or a Responsible Authority.
17. Where there is reasonable suspicion that drugs are being carried, the licensee shall ensure that the outer clothing, pockets and bags of those entering the venue are searched by a trained staff member of the same sex.
18. Clearly visible notices, in a form prescribed by the Council, shall be displayed advising those attending that: 1. It is a condition of entry that customers agree to be searched and 2. Police will be informed if anyone is found in possession of controlled substances or weapons.
19. Security arrangements are sufficient to discourage the sale and consumption of drugs and shall ensure such arrangements include regular checks of toilet areas.
20. Any customers known to have been previously convicted of committing criminal offences relating to drugs shall be excluded from the premises.
21. Records of incidents involving the use and/or detection of drugs shall be maintained and those records shall be available for inspection.
22. Confiscated and found drugs shall be stored, disposed, transferred in accordance with procedures agreed with the Lancashire Constabulary.
23. A drugs prevention strategy for the venue shall be developed and applied. The strategy shall include arrangements for the location of posters and the distribution of other information relating to drugs risks, the dangers associated with drugs and the legal provisions relating to drug use.
24. During the final hour of daily trading appropriate announcements are made or images are projected to remind patrons of the need to leave the premises without causing annoyance, nuisance or disturbance to local residents and to advise patrons of any taxi free-phone or collection arrangements available upon the premises.
25. The fire doors serving the premises should be kept closed at all times except for the purposes of escape in an emergency. This condition includes the doors on Simpson Street and Station Road.
26. Where appropriate prominent, clear and legible notices shall be displayed at all exits requesting the public respect the needs of local residents and to leave the premises and area quietly.
27. Noise or vibration shall not emanate from the premises so as to cause a nuisance to nearby properties.
28. The licence holder will give 10 working days' notice to the police of any occasion when a private function is to be held at the premises. On occasions when this provision has not been complied with, the licence holder must inform the police of all private functions and the police have the power of veto in relation to any functions in which the police are given less than 10 working days' notice. Risk assessments will be produced in relation to such functions, with consideration given to the employment of SIA registered doorstaff.
29. The CCTV system shall be installed, maintained and operated to the reasonable satisfaction of Lancashire Constabulary. All public areas are to be covered by the system. The system will incorporate a camera covering each of the entrance doors and the alcohol display areas and will be capable of providing an image which is regarded as identification standard.
30. The CCTV system will display on any recording the correct time and date of the recording.
31. The CCTV system will make recordings during all hours the premises are open to the public.
32. VCR tapes or digital recordings shall be held for a minimum of 31 days and 28 days respectively, after the recording is made and will be made available to the Police or any authorised persons acting for a Responsible Authority for inspection upon request.
33. A staff member who is conversant with the operation of the CCTV system will be on the premises at all times the premise are open to the public. This staff member will be able to show police recent data or footage when requested.
34. The Licence Holder or Designated Premises Supervisor shall notify the Police Licensing Unit on any occasion when the CCTV is to be inoperative for a period in excess of one working day and shall provide a certificate from a competent person stating the reason for the system being inoperative and the measures which have been taken to satisfy the licence conditions.
35. Appropriate signage alerting customers to CCTV recording shall be displayed in conspicuous positions on the premises.
36. Bi-annually documented maintenance checks of the CCTV system, including the recording system will be undertaken by a competent person to ensure that the system is in good working order and fit for purpose.
37. Any person under the age of 16 must be accompanied by a responsible adult and remains the responsibility of the accompanying adult at all times when using the premises. Members of staff are not allowed to be in sole supervision of children.
38. Persons under the age of 18 shall only be permitted to remain on the premises after 22:00 hours if attending a pre-arranged private function and shall remain in the first floor function room.
39. Functions which specifically target young people aged 17 - 18 years (for example birthday parties) will not be allowed to take place on the premises.
40. Alcohol shall not be sold or supplied on the first floor of the premises otherwise than to:
(a) Persons taking table meals on the premises and for consumption by such a person as an ancillary to the meal only during such meals.
(b) Persons attending a private or pre-arranged function, admission to which is by ticket or invitation obtained otherwise than at the door of the premises.
41. The supply of alcohol to persons on the first floor of the premises will be by waiter/waitress service only (except to those persons attending a pre-arranged private function) and only to persons seated at tables.
42. A notice or notices shall be displayed in the premises where they can be clearly seen and read and will indicate that it is unlawful for persons under 18 to purchase alcohol or for any person to purchase alcohol on behalf of a person under 18 years of age.
43. An authorisation of sales, signed and dated by the Designated Premises Supervisor, shall be kept at the premises showing all persons authorised by them to make sales of alcohol at the premises. All staff involved in sales will be at least 18 years of age and will receive training to promote the licensing objectives. All training to be documented and records made available on request to Lancashire Police or any authorised officer.
44. An incident book will be maintained, in which shall be recorded :
(i) All incidents of crime and disorder
(ii) Refused sales to suspected under age / drunken persons
(iii) A record of any person refused admission or asked to leave the premises
(iv) Details of occasions upon which the Police are called to the premises
(v) The use or discovery of drugs
That book shall be available for inspection by a Police Officer or authorised person.
