Annex 2 - Conditions consistent with the Operating Schedule
1 A log book or recording system shall be kept upon the premises in which shall be entered particulars of inspections made; those required to be made by statute, and information compiled to comply with any public safety condition attached to the premises licence that requires the recording of such information. The log book shall be kept available for inspection when required by persons authorised by the Licensing Act 2003 or associated legislation.
2 Prominent, clear and legible notices will be displayed at the exit requesting the public to respect the needs of nearby residents and to leave the premises and the area quietly.
3 Deliveries of goods necessary for the operation of the business will be carried out at such a time or in such a manner as to prevent nuisance and disturbance to nearby residents. Deliveries will not take place before 9am or after 5pm.
4 The Licensee will ensure that staff who arrive early morning or depart late at night (eg. for unpacking, pricing newly delivered goods) when the business has ceased trading conduct themselves in such a manner to avoid causing disturbance to nearby residents.
5 Customers will be asked not to stand around loudly talking in the street outside the premises.
6 Customers will not be admitted to premises outside of the opening hours.
7 The movement of bins and rubbish outside the premises will be kept to a minimum after 8.00pm to help to reduce the levels of noise produced by the premises.
8 Any lighting on or outside the premises will be positioned and screened in such a way so as to not cause a disturbance to nearby residents.
9 Adequate waste receptacles for use by customers will be provided in the unit.
10 Only fine wines to be sold. No ‘Alco-pops’, spirits or novelty drinks to be sold. No lager, beer and cider over 6% volume to be sold.
11 A minimum spend of £5 is required on food for the purchase of alcohol. All phone delivery orders for alcohol will be limited to a maximum of 2 litres per individual order and ancillary to food orders over £5.00.
12 All phone order deliveries shall be paid for via credit / debit card. A record of all transactions will be maintained. The transactions record will contain the name, delivery address, details of the order along with the requested time / date of the order. This shall be documented and available for inspection to Police officers or other authorised persons.
13 The licence holder is to support and rigorously enforce a Challenge 25 Proof of Age policy on all sales of alcohol. Any person who looks or appears to be under the age of 25 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification acceptable:
i. UK Photo driving licence;
ii. Passport;
iii. Proof of Age Standards Scheme Card;
iv. Armed Forces ID card
OR any other locally or nationally approved form of identification which may be introduced in the future.
Appropriate signage shall be clearly displayed with regards to Challenge 25. Such signage shall include a poster stating acceptable identification.
14 All staff involved in the sale and supply of alcohol shall receive suitable training in relation to the proof of age policy. All such staff are to receive regular refresher training at intervals of at least 6 months. Records to evidence this will be made available to officers on request.
15 All deliveries must be accepted by an individual in person (i.e. not left in a safe place or unsigned for). The Challenge 25 proof of age policy shall also be adhered to when delivering to person’s home addresses and a delivery refused if acceptable ID is not seen.
16 CCTV will be installed internally and externally at the premises and will comply with the following:
i. The system will display on any recording the correct time and date of the recording
ii. Digital recording shall be held for a minimum of 21 days after the recording is made and will be made available to the Police or any authorised persons acting for a Responsible Authority for inspection upon request.
iii. The system will, as a minimum, record images of the head and shoulders of all persons entering the premises.
17 A staff member who is conversant with the operation of the CCTV system will be on the premises at all times the premises are open to the public. This staff member will be able to show recent data or footage with the absolute minimum of delay when requested to a Police Officer or to a Local Authority Enforcement Officer.
18 The licence holder shall notify the Police Licensing Unit on any occasion when the CCTV is to be inoperative for a period in excess of one working day and shall provide a certificate from a competent person stating the reason for the system being inoperative and the measures which have been taken to satisfy the licence conditions.
19 Bi-annually documented maintenance checks of the CCTV system, including the recording system, will be undertaken by the licence holder to ensure that the system is in good working order and fit for purpose.
20 No boxing machines to be in operation in the premises.
21 Apart from the shop display, alcohol shall be stored in a locked room at the rear of the premises to which customers shall have no access.
22 All refusals of sales/delivery of alcohol shall be reported to the Designated Premises Supervisor or Premises Licence holder as soon as practicable. The details of the refusals shall be recorded in a book kept at the premises and available for inspection by a Police Officer or Authorised Officer.
The details shall include the date, time and location of the delivery address, the staff member who refused and a brief description of the grounds for refusal such as No ID, or Drunk etc.
