Annex 2 - Conditions consistent with the Operating Schedule
1 No entertainment of an adult nature will take place on the premises
2 Property is manned at all times during opening hours
3 Drugs:
1) Zero tolerance on drugs (Training will be provided to staff)
2) Random searches will be carried out
3) Toilets designed to minimise drug use
4) Staff trained on signs and symptoms of drug influence
5) Any drugs found will be recorded and confiscated and handed over to police
4 The premises licence holder or DPS will attend Blackpool pubwatch meetings
5 Challenge 25 in operation with staff trained on this
6 Signage around venue to keep noise down and respect residents
7 Staff will be trained in Health and safety and will receive first aid training
8 DPS will be IOSH qualified
9 Deliveries will be made on a Thursday around 9am weekly - additional and emergency deliveries will be during normal working hours and minimised
10 Commercial waste contractor will ensure waste is removed regularly
11 All sound system will be professionally equalised to reduce external volume
12 Appropriate soundproofing in venue will be considered
13 Age disclaimer on access to website
14 Test call backs on random orders to ensure purchaser is not fraudulent
15 Test purchases will be conducted on delivery provider (UPS) by Lateo at random periods
16 Internal test purchases on staff to quality check challenge 25 and other 'scenarios'
17 No children allowed on the premises from 2100 hours
18 From 1900 daily no under 18s are allowed on the premises without supervision
19 The property is protected internally and externally by CCTV recorded for 21 days with DTS
20 DPS and staff will attend regular proof of age training as and when required
21 Functions which specifically target young people aged 17-18 years (for example birthday parties) will not be allowed to take place on the premises.
22 An adequate number of licensed door supervisors will be on duty as appropriate to any risk assessment, however a minimum of one SIA registered door supervisor shall be on duty from 22:00hrs until the premises closes on Fridays and Saturdays. This also applies to Sundays prior to a bank holiday Monday, Christmas eve and New Years Eve.
23 CCTV will be installed internally and externally at the premises and will comply with the following:
a. The CCTV system shall be installed, maintained and operated to the reasonable satisfaction of Lancashire Constabulary. The system will incorporate a camera covering any entrance doors and will be capable of providing an image which is regarded as identification standard.
b. The system will display on any recording the correct time and date of the recording.
c. The system will make recordings during all hours the premises are open to the public.
d. The system will, as a minimum, record images of the head and shoulders of all persons entering the premises.
e. All recorded footage must be securely retained for a minimum of 21 days.
24 A staff member who is conversant with the operation of the CCTV system will be available to attend the premises within an hour if requested by Police. This staff member will be able to show police recent data or footage with the absolute minimum of delay when requested. This data or footage reproduction should be almost instantaneous.
25 All staff who are involved in the sale of alcohol shall receive suitable training in relation to the proof of age scheme to be applied upon the premises. All staff are to receive regular refresher training at intervals of 3- 6 months. Records to evidence this will be made available to an authorised officer upon request.
26 Staff shall ensure no drink is to be removed from the grounds or curtilage of the licenced premises in an unsealed container.
27 Frequent collection of glasses and bottles will be undertaken to ensure that empty containers do not accumulate in or around the licensed premises.
28 At least one personal licence holder will be contactable at all times the premises is open, (whose identity will be known to all other staff engaged in the supply or sale of alcohol) except in the case of emergency.
29 An authorisation of sales, signed and dated by the DPS, shall be kept at the premises showing all persons authorised by them to make sales of alcohol at the premises.
30 Security/staff arrangements will be sufficient to discourage the sale and consumption of drugs and shall ensure such arrangements include regular documented checks of toilets.
31 Clearly visible notices shall be displayed advising those attending that:
a. It is a condition of entry that customers agree to be searched and
b. Police will be informed if anyone is found in possession of controlled substances or weapons.
32 Any outside area which is used for the consumption of alcohol shall cease to be so used at 22:00hrs.
33 Any outside area should be closed by 23:00hrs so as not to cause nuisance to nearby residents.
34 The outside area of the venue will be regularly checked by a competent person.
35 An incident book will be maintained in which shall be recorded:-
i. All incidents of crime and disorder
ii. Refused sales to suspected under-age and drunken persons
iii. A record of any person asked to leave the premises or removed from the premises
iv. Details of occasions on which the police are called to the premises
v. A record of persons searched on suspicion that drugs are being carried and the reason for such suspicion
The book will be available for inspection by a police officer.
36 All external windows and doors should be closed after 10pm, except in the case of an emergency.
37 Patrols will take place by members of staff, internally and externally, to limit any noise pollution when entertainment is being offered within the premises.
38 The licence holder or designated premises supervisor shall make attempts to ensure members of the public leave quietly so as not to disturb neighbours.
39 During the final hour of daily trading appropriate announcements are made or images are projected to remind patrons of the need to leave the premises without causing annoyance, nuisance or disturbance to local residents and to advise patrons of any taxi free-phone or collection arrangements available upon the premises.
40 The volume of amplified sound used in connection with entertainment shall at all times be under the control of the licensee or management and the controlling mechanism shall be operated from a part of the premises inaccessible to the public.
41 Noise from any regulated entertainment or mechanical ventilation shall be inaudible within the nearest sensitive properties or, at the discretion of the Local Authority, shall not exceed some other pre-agreed limit, which does not cause unreasonable disturbance to the residents of these properties or their guests.
42 Any tasting events held at the premises will be subject of a risk assessment by the DPS.
43 No 'wet' drinks will be served before 11:00am only shop products and sealed bottles.
In relation to delivery of alcohol by courier/ internet sales the following conditions shall apply:
44 There shall be in place for the premises a written policy to prevent the sale or supply of alcohol to persons under 18 years of age. That policy shall require any customer who appears to look under the age of 25 to produce a recognised proof of age card accredited under the Proof of Age Standards Scheme (PASS) or a photo driving licence or passport indicating that they are over 18 years of age, or any other nationally approved ID.
45 Delivery drivers will require a signature from a person aged 18 or over before delivering goods. Proof of age will be required.
46 There will be no direct sales of alcohol from the delivery vehicle.
47 All deliveries must be accepted by an individual in person (i.e. not left in a safe place or unsigned for).
48 A record of all transactions will be maintained. The transactions record will contain the name, address, details of the order along with the requested time of the order. This shall be documented and available for inspection to Police officers or other authorised persons.
49 The premises website home page shall clearly state alcohol sales shall only be made to persons aged 18 or over.
50 No alcohol will be delivered to any person who the driver considers to be intoxicated.
