Annex 2 - Conditions consistent with the Operating Schedule
1 A Challenge 25 proof of age policy shall be implemented and adhered to. Any person who looks or appears to be under the age of 25 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification acceptable:
a. A recognised proof of age scheme accredited under the British Retail Consortiums Proof of Age Standards Scheme (PASS).
b. Photo driving licence.
c. Passport.
d. Official ID card issued by HM Forces or European Union bearing a photograph and date of birth of the holder.
If no suitable identification is provided the sale of alcohol will be refused.
2 All staff shall receive suitable training in relation to the proof of age scheme to be applied upon the premises as well as serving to drunks training. Records to evidence this shall be made available to an authorised officer upon request. Refresher training shall be conducted every 3 months as a minimum.
3 “Challenge 25” posters shall be displayed in prominent positions at the premises.
4 CCTV shall be installed internally at the premises and will comply with the following:
a) The CCTV system shall be installed, maintained and operated to the reasonable satisfaction of Lancashire Constabulary. The coverage should include the entrance/exit, checkout and main alcohol display. The system will be capable of providing an image which is regarded as identification standard.
b) The system shall display on any recording the correct time and date of the recording.
c) The system shall make recordings during all hours the premises are open to the public.
d) Digital recordings shall be held for a minimum of 21 days after the recording is made and will be made available to the Police or any authorised persons acting for a Responsible Authority for inspection upon request.
e) The system shall, as a minimum, record images of the head and shoulders of all persons entering the premises.
5 A staff member who is conversant with the operation of the CCTV system shall be on the premises at all times the premises are open to the public. This staff member shall be able to show recent data or footage with the absolute minimum of delay when requested to a Police Officer or to a Local Authority Enforcement Officer.
6 If the CCTV is not working correctly the Licence Holder shall take immediate steps to rectify the fault. A log of the steps shall be kept and be made available for inspection Police Officer or to a Local Authority Enforcement Officer.
7 At least one personal licence holder will be contactable and able to attend the premises within one hour while the supply or sale of alcohol is being undertaken (whose identity will be known to all other staff engaged in the supply or sale of alcohol) except in the case of emergency.
8 A4 sized warning notices to be displayed in public areas of the premises and at all entrances advising that CCTV is in operation. All the signs will comply with the requirements of the Data Protection Act 2002.
9 An incident book will be maintained within which full details of all occurences of disorder and refused alcohol sales at the premises will be recorded. This incident book will be kept on the premises at all times and be readily available for inspection by the Police.
10 No one carrying open or sealed bottles or glasses will be admitted to the premises at any time.
11 No customers will be permitted to take open containers of alcoholic or soft drinks from the premises.
12 A limited number of people will be allowed to enter the premises and an appropriate method for checking number of people entered into the premises would be incorporated.
13 Irreponsible drinks promotions will not be permitted.
14 Staff will be made aware of their social and legal obligations and their reponsibilites regarding the sale of alcohol and tobacco products.
15 All safety certificates and inspection reports must be kept on site and made available for inspection by officers of relevant statutory bodies.
16 An adequate and appropriate supply of first aid equipment and materials must be available on the premises.
17 Staff will regularly patrol the premises both in and outdoors to supervise the orderly conduct of patrons.
18 All external doors and windows will be kept shut other than for access or egress.
19 Outside the premises disposing and collecting of litter will be maintained regularly.
20 To minimise the effect of littering, litter bins will be installed and maintained both inside and directly outside the premises.
