Annex 2 - Conditions consistent with the Operating Schedule
1 Strong management controls and effective training of all staff so that they are aware of the premises licence and the requirements to meet the four licensing objectives with particular attention to;
a) no selling of alcohol to underage people
b) no drunk and disorderly behaviour on the premises
c) vigilance in preventing the use and sale of illegal drugs at the retail area
d) no violent and anti-social behaviour
e)no harm to children
2 Operating schedule providing the hours of operation and licensable activities during those hours.
3 Clear "Challenge 25" information to prevent the supply of alcohol to under-age drinkers.
4 CCTV system installed with recording.
5 As a licensed premises, we know that it is necessary to carry out functions or operate our business with a purpose of promoting these objectives. We promise to support these objectives through our operating schedules and other measures including staff training and qualifications, policies and strategic partnerships with other agencies.
6 CCTV system installed to monitor entrances, exits and other parts of the premises in order to address the prevention of crime.
7 Not selling alcohol to drunk or intoxicated customers.
8 Prevention and vigilance in illegal drug use at the retail unit.
9 Internal and external lighting fixed to promote the public safety objective.
10 Well trained staff adherence to environmental health requirements.
11 Training and implementation of underage ID checks.
12 All parts of premises and all fittings and apparatus therein, door fastenings and notices, lighting, heating, electrical, sanitary accommodation and other installations, will be maintained at all times in good order and in safe condition.
13 Noise reduction measures to address the public nuisance objective.
14 Deliveries of goods necessary for the operation of the business will be carried out at such a time or in such a manner as to prevent nuisance and disturbance to nearby residents.
15 Customers will be asked not to stand around loudly talking in the street outside the premises.
16 Customers will not be admitted to premises above opening hours.
17 Adequate waste receptacles for use by customers will be provided in the local vicinity.
18 "Challenge 25" sign which is a retailing strategy that encourages anyone who is over 18, but looks under 25 to carry acceptable ID (a card bearing a PASS hologram, a photographic driving licence or a passport) if they wish to buy alcohol.
19 Well trained staff about requirements for person' identification, age establishment, etc.
20 The primary purpose of the premises will be that of a restaurant / takeaway serving food. Food will be available at all times when alcohol is supplied on the premises.
21 The provision of food, including full meals and snacks will form a substantial element of the operation of the premises with sufficient furniture and seating provided and set out in such a way that it does not become a high volume, vertical drinking establishment. Seating inside the premises will be provided for at least 70% of the total maximum capacity of the premises as determined by a risk assessment.
22 Any outside area used for the consumption of alcohol will cease to be so used by 9pm. In the outside area, all customers consuming alcohol shall be seated.
23 Frequent collection of glasses and bottles will be undertaken to ensure that empty containers do not accumulate in or around the licensed premises.
24 Appropriate measures will be taken to ensure no drink is to be removed from the grounds or curtilage of the licensed premises in an unsealed container.
25 An authorisation of sales, signed and dated by the DPS, shall be kept at the premises showing all persons authorised by them to make sales of alcohol at the premises.
26 A Challenge 25 proof of age policy shall be implemented and adhered to. Any person who looks or appears to be under the age of 25 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification acceptable:
· A recognised proof of age scheme accredited under the British Retail Consortiums Proof of Age Standards Scheme (PASS).
· Photo driving licence.
· Passport.
· Official ID card issued by HM Forces or European Union bearing a photograph and date of birth of the holder.
If no suitable identification is provided the sale of alcohol to them will be refused. Suitable signage will be displayed to specify the Challenge 25 policy is in place.
27 All staff to have received suitable training in relation to the proof of age scheme. Refresher training on underage sales to be provided to all staff every three to six months. Records to evidence this will be made available to an authorised officer upon request.
28 CCTV must be installed internally and externally at the premises and must comply with the following:
a) The CCTV system shall be installed, maintained and operated to the reasonable satisfaction of Lancashire Constabulary. The entrance and bar areas are to be covered by the system. The system will incorporate a camera covering each of the entrance doors and will be capable of providing an image which is regarded as identification standard.
b) The system will display on any recording the correct time and date of the recording.
c) Digital recording shall be held for a minimum of 21 days respectively, after the recording is made and will be made available to the Police or any authorised persons acting for Responsible Authority for inspection upon request.
29 The premises licence holder will risk assess the requirement for door supervisors at the premises and shall employ door supervisors in such numbers and at such times as is deemed necessary by the risk assessment.
30 Security/staff arrangements will be sufficient to discourage the sale and consumption of drugs and shall ensure such arrangements include regular documented checks of toilets.
31 All furniture in the outside area is to be either fixed or, if not fixed, to be removed from the outside no later than 21:30hrs.
