Annex 2 - Conditions consistent with the Operating Schedule
1. A minimum of one SIA licensed member of door staff will be on duty from 2100 hours every Friday and Saturday, Sunday before Bank Holiday, All bank holidays, Christmas Eve and New Year's Eve.
2. At all other times the licence holder will determine an appropriate number of door staff, having regard to a risk assessment maintained by the premises licence holder. The document will be available for inspection if required by Police or authorised officer upon request.
3. The use of the outside area will cease at 2200 each night including the playing of any recorded music.
4. The outside area of the venue will be checked by a competent person at intervals of a minimum of 30 minutes.
5. All tables and chairs in the outside area shall either be fixed to the floor or be stacked, secured and covered no more than 30 minutes after the time at which patrons are no longer permitted to consume drinks in the area.
6. In the outside area all persons consuming drinks will be seated.
7. CCTV will be installed internally and externally at the premises and will comply with the following:
i. The CCTV system shall be installed, maintained and operated to the reasonable satisfaction of Lancashire Constabulary. All public areas of the premises are to be covered by the system. The system will incorporate a camera covering each of the entrance doors and will be capable of providing an image which is regarded as identification standard.
ii. The system will display on any recording the correct time and date of the recording.
iii. The system will make recordings during all hours the premises are open to the public.
iv. Digital recording shall be held for a minimum of 30 days, after the recording is made and will be made available to the Police or any authorised persons acting for a Responsible Authority for inspection upon request.
v. The system will, as a minimum, record images of the head and shoulders of all persons entering the premises.
8. A staff member who is conversant with the operation of the CCTV system will be on the premises at all times the premises are open to the public. This staff member will be able to show recent data or footage with the absolute minimum of delay when requested to a Police Office or to a Local Authority Enforcement Officer.
9. The licence holder shall notify the Police licensing unit on any occasion when the CCTV is to be inoperative for a period in excess of one working day and shall provide a certificate from a competent person stating the reason for the system being inoperative and the measures which have been taken to satisfy the licence conditions.
10. Appropriate signage alerting customers to CCTV recording shall be displayed in conspicuous positions on the premises.
11. At least one personal licence holder will be available on the licensed premises while the supply or sale of alcohol is being undertaken (whose identity will be known to all other staff engaged in the supply or sale of alcohol) except in the case of emergency.
12. Frequent collection of glasses and bottles will be undertaken to ensure that empty containers do not accumulate in or around the licensed premises.
13. No person in possession of a drink in a sealed or unsealed container will be allowed to enter the premises except for the purposes of delivery.
14. Appropriate measures will be taken to ensure staff prevent the removal of bottles or glasses from the curtilage and grounds of the licensed premises.
15. No customer will be permitted to leave the premises, including the outside area in possession of any unsealed container of alcohol.
16. No customer will be permitted to leave the Bistro via the internal exit in possession of any unsealed container of alcohol.
17. All drinking vessels used at the premises will be made of toughened glass or polycarbonate. A risk assessment will exist in relation to the use of polycarbonates at suitable times, including in the outside area. This risk assessment shall be available for inspection by Police or authorised officer upon request.
18. An authorisation, signed and dated by the Designated Premises Supervisor, shall be kept at the premises showing all persons authorised by them to make sales of alcohol at the premises.
19. A Challenge 25 proof of age policy shall be implemented and adhered to. Any person who looks or appears to be under the age of 25 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification acceptable:
i. A recognised proof of age scheme accredited under the British Retail Consortiums Proof of Age Standards Scheme (PASS).
ii. Photo driving licence.
iii. Passport.
iv. Official ID card issued by HM Forces or European Union bearing a photograph and date of birth of the holder.
If no suitable identification is provided the sale of alcohol to them will be refused.
20. Suitable signage will be displayed to specify the Challenge 25 policy is in place.
21. All staff to have received suitable training in relation to the proof of age scheme. Refresher training on underage sales to be provided to all staff every 3-6 months. Records to evidence this will be made available to Police or authorised officer upon request.
22. Tower Cinemas are committed to working with local authorities and working groups to promote Blackpool as a safe and nuisance free space for children and families.
23. Tower Cinemas operate under strict management policies to ensure safeguarding of children from inappropriate film material.
24. Signage will be erected asking patrons to respect the local community and leave quietly.
25. The Backlot management will keep a refusal register on site including date and time of refusal and will keep track of any anti social behaviour, ensuring to liaise with relevant local authorities to share information on persistent offenders.
26. A full building fire risk assessment will be undertaken prior to opening the venue.
27. Fire training will be given and refreshed every 6 months.
28. The Backlot will conduct weekly fire alarm tests.
29. Fire evacuation chairs are to be installed at exit points.
30. The Backlot will ensure a First Aid trainer will be on site at all times.
31. The Backlot management will deploy a strategy to manage the transportation of guest drinks between the ground floor diner and 1st floor/2nd floor auditorium.
32. The Backlot management will make aware Houndshill management and any other relevant parties of activity taking place outside of 'standard' operating hours to ensure a safe exit from the premise, including the car park spaces.
33. Children under 12 years of age must be accompanied by an adult who is at least 18 years of age at all times.
34. No unaccompanied children under the age of 15 after 19.00pm.
35. No under 18s are allowed on the Premise after 22.00pm Sunday to Thursday and after 23.00pm Friday and Saturday.
36. The venue will not operate under a 24 hour licence as standard but will on occasion screen midnight screenings of Hollywood film releases, host national and international gaming conventions and watch parties where 'out of business hours' licensing may be required. The expected alcohol licensing hours for the business will be 10.00 to 00.00 (Sunday to Thursday) and 10.00 to 02.00 (Friday & Saturday).
