Annex 2 - Conditions consistent with the Operating Schedule
1 At least one personal licence holder will be available on the licensed premises while the supply or sale of alcohol is being undertaken (whose identity will be known to all other staff engaged in the supply or sale of alcohol) except in the case of emergency.
2 Another member of staff shall be nominated to act for the Designated Premises Supervisor, in their absence, whose identity is known by all other staff when such absence occurs.
3 Risk assessments carried out by or on behalf of the licence holder which relate to a licensing objective will be available for inspection by an officer or a Responsible Authority.
4 The licence holder is to support and rigorously enforce the Challenge 21 proof of age policy. Any person who looks or appears to be under the age of 21 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification acceptable: UK photo driving licence, passport, Proof of Age standards scheme card.
5 All staff to have received suitable training in relation to the proof of age scheme to be applied upon the premises. Records to evidence this will be made available to an authorised officer upon request.
6 The premises are operated in accordance with the principles outlined by the 'Nightsafe' scheme, as are relevant to those premises, and indicated in the associated leaflet.
7 The premises shall be operated in participation with the 'Pubwatch' Scheme (radio link if applicable).
8 An adequate number of licensed door supervisors will be on duty as appropriate to any risk assessment and in accordance with guidance under the 'Nightsafe' scheme.
9 Any individual employed on the premises to carry out a security activity must be licensed by the SIA.
10 All door staff employed at the entrance / exit of the licensed premises will wear a reflective jacket / armband of a design approved by the Lancashire Constabulary and the Local Authority.
11 All doorstaff will comply with SIA requirements relating to the availability of registration documents for inspection.
12 All security staff will display their badge in accordance with SIA conditions.
13 All security staff will sign in and out to include name/ time/ badge number/ signature when required the security staff will be located at the entrances of the venue.
14 All security staff will conduct regular checks of the site to include in particular toilets and external areas.
15 All security staff are fully briefed in respect to known barred persons as laid down in the local “nightsafe” programme. In accordance with the nightsafe policy, we operate the 1:100 recommendation on our key trading nights (Friday and Saturday).
16 CCTV will be installed internally and externally at the premises and will comply with the following:
The CCTV system shall be installed, maintained and operated to the reasonable satisfaction of Lancashire Constabulary. All public areas of the premises are to be covered by the system. The system will incorporate a camera covering each of the entrance doors and will be capable of providing an image which is regarded as identification standard.
i. The system will display on any recording the correct time and date of the recording
ii. The system will make recordings during all hours the premises are open to the public
iii. VCR tapes or digital recordings shall be held for a minimum of 31 days and 28 days respectively, after the recording is made and will be made available to the Police or any authorised person acting for a Responsible Authority for inspection upon request.
iv. The sytem will, as a minimum, record images of the head and shoulders of all persons entering the premises.
17 A staff member who is conversant with the operation of the CCTV system will be on the premises at all times the premises are open to the public. This staff member will be able to show recent data or footage with the absolute minimum of delay when requested to a Police Officer or to a Local Authority Enforcement Officer.
18 The Licence Holder or Designated Premises Supervisor shall notify the Police Licensing Unit on any occasion when the CCTV is to be inoperative for a period in excess of one working day and shall provide a certificate from a competent person stating the reason for the system being operative and the measures which have been taken to satisfy the licence conditions.
19 Appropriate signage alerting customers to CCTV recordings shall be displayed in conspicuous positions on the premises.
20 Annual documented maintenance checks of the CCTV system, including the recording system, will be undertaken by the Designated Premises Supervisor to ensure that the system is in good working order and fit for purpose.
21 Only toughened glass vessels are used to dispense beer to customers.
22 Where there is reasonable suspicion that drugs are being carried, the licensee shall ensure that the outer clothing, pockets and bags of those entering the venue are searched by a trained staff member of the same sex.
23 Clearly visible notices, in a form prescribed by the Council, shall be displayed advising those attending that 1. It is a condition of entry that customers agree to be searched and 2. Police will be informed if anyone is found in possession of controlled substances or weapons.
24 Security arrangements are sufficient to discourage the sale and consumption of drugs and shall ensure such arrangements include regular checks of toilet areas.
25 Any customer known to have been previously convicted of committing criminal offences relating to drugs shall be excluded from the premises.
26 Records of incidents involving the use and / or detection of drugs shall be maintained and those records shall be available for inspection.
27 Confiscated and found drugs shall be stored, disposed, transferred in accordance with procedures agreed with the Lancashire Constabulary.
28 A drugs prevention strategy for the venue shall be developed and applied. This strategy shall include arrangements for the location of posters and the distribution of other information relating to drugs risks, the dangers associated with drugs and the legal provisions relating to drug use.
29 The venue operates a “zero” tolerance on drugs and posters detailing this are located at strategic points around the unit in particular on entry and in the toilets. Staff and security will carry out routine checks.
30 Any persons already in the pub suspected of using or carrying drugs will be searched in the staff room where a minimum of 2 staff will be present, any drug paraphernalia will be retained in a sealed bag, recorded in the incident log and passed over to the police.
31 The volume of amplified sound used in connection with entertainment shall at all times be under the control of the licensee or management and the controlling mechanism shall be operated from a part of the premises inaccessible to members or their guests.
32 The premises shall maintain a drinks pricing policy which complies with any local authority resolution made in accordance with approval from the Licensees Forum or any successor liaison body recognised by the Licensing Authority.
33 The licence holder shall erect and maintain signage (in a form approved by the Licensing Authorities) on or adjacent to all staffed exits advising patrons of the Street Drinking Order and the intention of doorstaff to enforce a 'No exit with a bottle' policy.
34 The licence holder shall ensure that the arrangement for the storage of empty bottles prevents unauthorised access to those bottles.
35 Frequent collection of glasses and bottles will be undertaken to ensure that empty containers do not accumulate in or around the licensed premises and beer garden. A record of regular checks on the external area will be maintained.
36 The licence holder shall ensure free cold drinking water is available on request and that adequate supplies of chilled soft drinks and bottled water should be available for sale at the bar(s).
37 Persons under 18 years shall not be permitted to remain in the downstairs bar after 9pm.
38 Persons under 18 years shall not be permitted to remain anywhere on the premises after 10.30pm.
39 Persons under 16 years shall not be permitted to remain anywhere on the premises after 9pm unless accompanied by a responsible adult.
40 Any person under the age of 16 remains the responsibility of the accompanying adult when using the premises. Members of staff are not allowed to be in sole supervision of children, which remains the responsibility of the accompanying adult at all times.
41 Whenever children are allowed upon the premises, any entertainment offered within the premises shall be suitable for young persons.
42 There will be substantial refreshment available in the upstairs venue at all times when the premises are open for trade.
43 The supply of intoxicating liquor in the upstairs venue will be waiter / waitress service only and only to persons seated at tables.
44 Only persons who are 18 years of age or over shall be able to sell or supply alcohol.
45 A separate entrance will be provided for families to enter the premises.
46 Staff will be CRB checked.
47 Noise from any Regulated Entertainment, Mechanical Ventilation or Refrigeration Plant shall be inaudible within the nearest sensitive properties or, at the discretion of the Local Authority, shall not exceed some other pre-agreed limit, which does not cause unreasonable disturbance to the residents of these properties or their guests.
48 All internal doors to any entrance/exit point, fire exit doors and external windows shall be closed during hours of any Regulated Entertainment except in the event of an emergency, save for the purpose of access and egress.
49 Vibration produced as a result of any Regulated Entertainment shall not be perceptible in any adjoining or nearby sensitive properties.
50 The licence holder shall erect and maintain in a prominent position at every exit a clear and conspicuous notice requesting patrons to avoid causing noise, nuisance or disturbance to local residents.
51 The collection and disposal of bottles and refuse should not take place externally between the hours of 2200 and 0800 hours.
52 The Premises Licence Holder shall provide adequate ventilation so as to ensure that cooking, noxious or persistent smells generated at the premises do not cause nuisance to properties within close proximity.
53 The Premises Licence Holder shall provide suitable containers for the storage of waste, which are constructed and maintained to prevent the removal of such waste by vandals, thieves, animals, accidental spillage or inclement weather. This shall include any external waste receptacles provided for the disposal of all discarded smoking related litter, so as to prevent waste litter being deposited onto the highway.
54 Any flashing or bright lights on or outside the licensed premises shall be positioned or screened in such a manner so as not to cause inconvenience to nearby properties.
55 All external smoking areas provided for the premises shall be located in such a position, so that any associated use does not cause a nuisance to any nearby noise sensitive properties.
56 Weekly fire alarm and equipments tests will be carried out and records kept in our fire log book.
57 Annual service/ inspection record will be retained on site for inspection by local authorities.
58 All staff will be fully trained in fire procedures and records of training will be retained in the fire log book - this will include knowledge and locations of fire exits and meeting points as well as locations and uses of fire fighting equipment.
59 A full evacuation drill will be carried out every 6 months and logged in the fire book.
60 All fire exits will be checked 3 times each day to ensure that they are clear.
61 All fire safety signs will be checked on a daily basis to ensure they are fully operational
62 A full supply of first aid materials such as plasters, bandages, dressings and sterile wipes will be held in the first aid box at all times. Boxes are located in the kitchen and bar area an accident book will be retained on site to log any accidents or near misses.
63 All staff are trained in safe systems of work which ensures that areas are kept clear to minimize any potential risks of accidents or incidents.
64 Regular visual checks are completed by the staff and records retained.
65 Glass collectors and staff will ensure that tables are cleared and staff will ensure that tables are cleared and wiped on a regular basis.
66 Where feasible, the DPS will ensure that all exterior lighting is fully maintained and in a good working order.
67 Regular checks are carried our to ensure that glasses/bottles and other items are cleared. At busy periods these checks will be made every 30 minutes.
68 External bins will be regularly emptied and secured in a lockable compound.
69 All food handlers will be fully trained in basic food Hygiene regulations All food stuffs will be supplied through a designated company supplier.
70 The site will benefit from regular visits from out nominated pest control company.
71 A minimum of 1 person who holds a Personal Licence will be at the premises at all times whilst the sale of alcohol is being undertaken.
72 The unit benefits from a fully operational digital CCTV system. The system will be maintained through a nominated supplier on an annual service contract. Only members of the management team will have access to they system which is housed in a secure area.
73 All security staff engaged at The Townsman will be SIA registered.
74 The pub will benefit from an internal radio system at all times.
75 The DPS will be a full member of the local pubwatch as a such attend all meetings , where this is not practical, the DPS will endeavour to send a representative on his/ her behalf.
76 The DPS and staff will ensure that any persons barred under the local pubwatch scheme are not allowed entry at any time.
77 Staff and security will be fully briefed at monthly staff are trained in customer service, managing difficult situations, Fire safety, COSHH, First Aid Reporting, Challenge 25 and Health & Safety.
78 All staff will be trained in noise regulations and records retained on file customers will be encouraged to vacate the site in a quiet and orderly fashion to respect our Neighbours.
79 Bottle skips will not be emptied into our external bins between the hours of 10pm and 7am.
80 All AC/ ventilation and plumbing is maintained by a nominated supplier and faults reported immediately to reduce the risk of disturbance.
81 Taxi numbers are displayed at the entrance to assist in dispersal of customers.
82 All staff are trained in Challenge 25. Security and bar staff will challenge any person who appears to be under the age of 21 - we will only accept passports, citizens card or driving licences. Ongoing training will be covered at monthly staff meetings.
83 The local authority conduct regular test purchases in the area. Signage detailing the law on the sales of alcohol are in situ at the entrance and the bar.
84 All AWP’s and cigarette vending machines will be fully covered by CCTV and will have clear notices relating to the minimum age of 18 years to play or purchase. Anyone attempting to play or purchase who is under the legal age limit will be requested to either stop or leave.
85 An authorisation of sales, signed and dated by the Designated Premises Supervisor, shall be kept at the premises showing all persons authorised by them to make sales of alcohol at the premises.
86 An incident book will be maintained, in which shall be recorded:
i. All incidents of crime and disorder
ii. Refused sales to suspected under age / drunken persons
iii. A record of any person refused admission or asked to leave the premises
iv. Details of occasions upon which the Police are called to the premises
v. The use or discovery of drugs
That book shall be available for inspection by a Police officer or authorised person.
87 The outside area is to be used only for consumption of alcohol and no retail of alcohol will take place in this area.
88 The outside area is to be closed for consumption of alcohol by 23.00 hours on a daily basis.
