Additional Conditions

• Annex 1 - Mandatory conditions

   

  1              The premise shall be used for the purpose of habitually providing for reward board and lodging, including breakfast and one other at least of the customary main meals.

   

  2              No supply of alcohol may be made under the premises licence -

   

  a)              At a time when there is no designated premises supervisor in respect of the premises licence,

   

  or

   

  b)              At a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  3              Every supply of alcohol under the premise licence must be made or authorised by a person who holds a personal licence.

   

  4              Suitable beverages other than intoxicating liquor (including drinking water) shall be equally available for consumption, with or otherwise as an ancillary to, meals served in the licensed premises.

   

  5              Intoxicating liquor shall not be sold or supplied on the premises otherwise than to persons residing there or their private friends, bona fide entertained by them at their own expense, and for consumption by such a person or his private friend so entertained by him either on the premises or with a meal supplied at but to be consumed off the premises.

   

  6              The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.

   

  An irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children -

   

  a.              Games or other activities which require or encourage, or are designed to require or encourage individuals to -

  i.              Drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or

  ii.              Drink as much alcohol as possible (whether within a time limit or otherwise);

  b.              Provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined by section 159 of the Act);

  c.              Provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less;

  d.              Provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependant on -

  i.              The outcome of a race, competition or other event or process, or

  ii.              The likelihood of anything occurring or not occurring;

   

  7              The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).

   

  8              The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.

   

  9              The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol. The policy must require individuals who appear to the responsible person to be under 18 year of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.

   

  10              The responsible person shall ensure that -

  a.              Where any of the following alcoholic drink is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures -

  i.              Beer or cider: ½ pint;

  ii.              Gin, rum, vodka or whisky: 25ml or 35ml; and

  iii. Still wine in a glass: 125ml; and

  b.              Customers are made aware of the availability of these measures.

  Annex 2 - Conditions consistent with the Operating Schedule

   

  1              There will be Proof of Age monitoring and adoption of Blackpool Council's current "Proof of Age Card" scheme. Posters promoting the scheme will be displayed at the premises.

   

  2              A CCTV system will be installed at the premises which as a minimum -

   

                       Shall incorporate an exterior mounted camera for each public entry / exit, to or from the premises aimed towards the doorway(s) and its environs;

                       Shall ensure that all archived material will be capable of being copied to another medium on site which can be taken from the premises. The applicant will be capable of downloading or copying archived material and if available the system "user's manual" shall be kept readily available together with contact details of installer / manufacturer;

                       Will display the correct time and date on both live and recorded material if available and be adjusted for British Summer Time;

                       Be regularly serviced at agreed intervals, (for example every 12 months) and a service record kept on site;

                       Be capable of archiving recorded material for a minimum of 28 days if digital and if a VHS format is being used: 31 x videocassettes numbered 1 to 31 consecutively shall be used on the corresponding day of the month and not used again until the corresponding day of the following month(s);

                       Ensure that the recording equipment and tapes / discs should be kept in a secure environment under the control of the owner / user or responsible named individual;

                       Ensure appropriate signage indicating an operative CCTV system in conspicuous positions, and

                       Ensure written records are kept in addition

   

  3              The applicant will take all reasonable steps to ensure the dispersal of customers, i.e. displaying signs, asking people to leave the area quietly and quickly and providing taxi phone numbers, to prevent them congregating on the street outside the premises.

   

  4              The applicant will join and support any "Nightsafe", "Pubwatch" or "Alcohol Awareness Scheme" that may be operated in the location of the premises from time to time by the Police, Licensing Authority or as part of a national initiative and where it is considered appropriate from time to time:

   

                       Implement a radiolink;

                       Employ SIA registered doorstaff following a risk assessment;

                       Adhere to "Cutting Edge" recommendations by using toughened glass drinking vessels, implementing enhanced glass and bottle collection and floor cleaning, sponsorship of a purpose made bottle bin outside the premises, prevention of access to bottles and glasses, the provision of secure bottle stores and enforcement of a 'no exit with a bottle' policy by door staff.

                       Effectively manage capacity

                       Participate in the promotion of the 'Street Drinking Ban'

                       Support the drinks discounting protocol 2003

   

  5              The DPS is aware of their responsibilities to themselves, their staff and customers in respect of public safety and will take all reasonable steps to ensure the maintenance of all provided fire and other safety arrangements (including evacuation procedures) and equipment in accordance with the requirements of current legislation, including means of escape arrangements, fire extinguishing appliances and fire detection installations.

   

  6              Regulated entertainment will not cause noise pollution to adjoining and nearby properties.

   

  7              Reasonable steps will be taken to recognise the rights of local residents and to encourage customers to leave quietly. Notices will be displayed around the premises asking patrons to leave quietly.

   

  8              Additional commercial refuse will be removed regularly.

   

  9              Telephone numbers for local taxi firms will be displayed in a prominent location.

   

  10              If the DPS deems it necessary to control noise, windows may be kept shut.

   

  11              Any children under the age of 16 must be accompanied by a parent / guardian and will remain the responsibility of the accompanying adult when visiting the premises. Staff are not allowed to be in sole supervision of children which remains the responsibility of the accompanying adult at all times.

   

  12              The Challenge 21 Scheme will be in operation at the premises. Staff have been trained in the scheme and are aware of the need to demand an acceptable form of I.D. (i.e. an accredited proof of age scheme card or passport).

   

  13              Children will be required to leave the premises by 21.00 hours.

   

  14              Tables will be cleared on a regular basis to ensure that children do not access drinks that have not been finished.
