Annex 2 - Conditions consistent with the Operating Schedule
1 There shall be no limitation on the sale and supply of alcohol to residents.
2 Permitted hours for licensable activities on New Year’s Eve extend from the end of permitted hours on New Year’s Eve to the start of permitted hours on the following day.
3 The Licensee, that is the person in whose name the premises licence is issued, shall ensure that at all times when the premises are open for any licensable activity, there are sufficient competent staff on duty at the premises for the purpose of fulfilling the terms and conditions of the licence and for preventing crime and disorder.
4 No music shall be provided to any external areas.
5 The licensee shall take all reasonably practicable steps to ensure that patrons entering into and departing from the licensed premises do not cause nuisance or annoyance to adjoining residents or passers by.
6 Noise from within the premises shall be inaudible within any adjoining residential or commercial premises.
7 The licensee shall display notices and make announcements requesting departing patrons to have regard to their neighbours.
8 The licensee shall undertake (and from time to time review) an assessment of the risks to persons arising from the use of glass drinking vessels (not including drinks served in bottles) as potential weapons. Where an assessment shows a significant risk, the licensee(s) shall ensure that only the most suitable toughened glass or non-glass drinking vessels are used.
9 The licensee shall take all reasonably practicable steps to ensure that bottles and drinking vessels are not taken from the premises.
10 No person shall be allowed to leave the premises whilst in the possession of any drinking vessel or open glass bottle, whether empty or containing any beverage.
11 No alcohol drinks shall be sold or supplied for consumption off the premises.
12 The licensee shall ensure that all staff will undertake training in their responsibilities in relation to the sale of alcohol, particularly with regard to drunkeness and underage persons. New staff will be trained before commencing their duties. All established staff will be subject to periodic refresher training (not normally less than six monthly intervals). Records will be kept of all training and refresher training.
13 All members of staff at the premises shall see "credible photographic proof of age evidence" from any person who appears to be under the age of 21 and who is seeking to consume alcohol. Such credible evidence, which shall include a photograph of the customer, will either be a passport, photographic driving licence or Proof of Age card carrying a "Pass" logo.
14 A suitably worded sign of sufficient size and clarity must be displayed at the point of entry to the premises and in a suitable location at the point of sale, advising customers that they may be asked to produce evidence of their age.
15 The licensee shall ensure customers or a member of staff are able to telephone a local taxi company to order a taxi and that staff will assist customers as appropriate by contacting other or alternative taxi firms free of charge where the existing local company is unable to cope with demand.
16 In addition to maintaining the current "Challenge 21" policy, the licensee will actively consider the viability of an "un-restricted membership system" incorporating photo ID's similar to those previously operated by the proprietors at other premises as an additional measure of management of patrons. These provisions shall be subject to review by the licensee approximately every six months.
17 The licensee will participate in and co-operate with schemes operated by the local police or other authorities in relation to the search for and seizure of unlawful items and substances. The licensee will liaise with the local police / appropriate authorities.
18 The licensee will continue only to promote responsible drink promotions. In the event that any drink promotion, however modest, is shown to contribute to problems within the vicinity, the licensee shall withdraw such promotion upon the appropriate representations from the relevant authorities. For the avoidance of doubt the licensee will not advertise, promote, sell or supply alcoholic drinks in such a way that it is intended or likely to encourage persons to consume alcohol to an excessive extent.
19 The licensee shall introduce a policy to assist in the dispersal of patrons from the venue and immediate vicinity, and instruct staff in the implementation of this policy.
20 There will be responsible management of the premises at all times by trained and supervised staff. The management will consider and adopt best practices where appropriate.
21 No off sales.
22 Intoxicants to be sold only to:
a) Residents in the hotel and their bona fide guests, and
b) Persons having a substantial meal, and
c) Bona fide guests attending organised functions and / or pre-booked functions.
