Annex 2 - Conditions consistent with the Operating Schedule
1 Permitted hours for the sale of alcohol :
(a) Twenty four hours to residents of the hotel and their bona fide guests.
(b) To non-residents :
(i) Monday - Sunday, 11.00 am to 12 midnight
(ii) Friday and Saturday of each May, Spring and August Bank Holiday, 11.00 to 01.00 am.
(iii) Friday, Saturday and Sunday of each Easter Bank Holiday, 11.00 am to 01.00 am.
(iv) Christmas Eve, Christmas Day and Boxing Day, 11.00 am to 01.00 am.
(v) On New Year’s Eve from the end of permitted hours on New Year’s Eve to the start of permitted hours on the following day (or if there are no permitted hours on the following day, midnight on 31st December)
A further hour is allowed for the consumption of the alcohol in addition to the above hours, after which the premises will be closed to non-residents.
2 Permitted hours for the provision of Regulated Entertainment :
(a) No restrictions for residents and their bona fide guests
(b) For non-residents:
(i) Monday - Sunday, 11.00 am to 12 midnight.
(ii) Friday and Saturday of each May, Spring and August Bank Holiday, 11.00 am to 01.00 am.
(iii) Friday, Saturday and Sunday of each Easter Bank Holiday, 11.00 am to 01.00 am.
(iv) Christmas Eve, Christmas Day and Boxing Day, 11.00 am to 01.00 am.
(v) On New Year’s Eve from the end of permitted hours on New Year’s Eve to the start of permitted hours on the following day (or if there are no permitted hours on the following day, midnight on 31st December)
3 Permitted hours for the provision of Late Night Refreshment:
(a) No restrictions for residents and their bona fide guests
(b) For non residents:
(i) Monday to Sunday 2300 - 0100
(ii) From 2300 on 31st December to 0500 on 1 January
4 All staff to have received suitable training in relation to the proof of age scheme to be applied upon the premises. Records to evidence this will be made available to an authorised officer upon request.
5 Appropriate measures will be taken to ensure staff prevent the removal of bottles or glasses from the curtilage and grounds of the licensed premises.
6 At least one Personal Licence Holder is available while the supply or sale of alcohol is being undertaken (who's identity will be known to all other staff engaged in the supply of alcohol) except in the case of emergency.
7 Only toughened glass vessels are used to dispense beers to customers.
8 The premises are operated in acordance with the principles outlined by the 'Nightsafe' initiative, as are relevant to those premises.
9 Noise from any regulated entertainment will be inaudible at the nearest sensitive premises or, at the discretion of the Local Authority, shall not exceed some other pre-agreed limit, which does not cause unreasonable disturbance to neighbouring residents or their guests.
10 The volume of amplified sound used in connection with entertainment shall at all times be under the control of the Licensee or Management and the controlling mechanism shall be operated from a part of the premises inaccessible to the public.
11 Regular assessments of the noise coming from the premises during regulated entertainment shall be made and the noise level adjusted accordingly.
12 All external windows in the function room to remain closed during regulated entertainment except in the event of an emergency.
13 Signs will be maintained in the bar area indicating that there will be no further sales or supply of alcohol to non-residents after 12 midnight or 01.00 am. on the specified public holidays.
14 At closing time bona fide guests of residents must be able to establish they fulfill this definition.
15 At 12 midnight or 01.00 am. on the specified public holidays, the ground floor lounge bar shutters will be closed until all members of the public have vacated the premises and there will be no further sales or supply of alcohol until the premises are clear of the general public.
16 The Designated Premises Supervisor, when present, and all members of staff will ensure that all lawful instructions and / or directions given by the Police are complied with.
17 The maximum number of persons allowed in the licensed parts of the premises will be restricted to 120.
18 There will be no promotions that encourage illegal, irresponsible or immoderate consumption of alcohol.
19 No person in possession of a drink in a sealed or unsealed container will be allowed to enter the premises except for the purpose of delivery.
20 Adequate provisions will be made to prevent unauthorised access to the storage of empty bottles.
21 All parts of the premises will, at all times, be kept free from defect and no structural changes or alterations on any part of the premises will be made without the prior approval of the council.
22 All exits and escape routes to the exits (including external escape routes) from the premises will be maintained in good repair, correct working order and kept free from all obstructions when the public are on the premises. External escape routes will also be kept free from ice and snow.
23 All doors or gates both inside and outside the premises which are on an escape route will be fitted only with approved fasteners and will at all times be properly maintained, free from obstruction and be capable of being opened easily and fully so that they do not restrict the public leaving the premises.
24 All exit doors from premises or enclosure(s) surrounding it will be capable of being opened by any person without the use of a key, card, code or other similar means, and be kept free from all fastening devices when the premises are open to the public.
25 All exit routes and doors on such routes will be checked at regular intervals when the premises are open to the public to ensure that they are free from defect, obstruction, trip hazards and the surfaces are not slippery.
26 The method of opening any exit door or gate from the premises will be clearly displayed immediately above or below the fastening in white block lettering on a green background in letters not less than 50mm high.
27 Where a fire-resisting door is fitted within the premises and that door is required to be kept closed at all times then the door will be clearly marked on both sides with the words "FIRE DOOR KEEP CLOSED" in block letters not less than 50mm high and clearly visible when the premises are open to the public.
28 Any door or gate in the premises which is not an exit door or gate will have a sign bearing the word "PRIVATE" in block letters not less than 50mm high.
29 Any chain, padlock or any other device used to lock an exit door when the premises are not in use will be removed and stored when the premises are open to the public.
30 The furniture or seating in the premises will be arranged so that it does not obstruct any exit, route to any exit or to any facility within the premises.
31 Where any furnishing or fitting in the premises including wall, floor and ceiling linings requires further periodic treatment to maintain the surface spread fo flame qualities, they will be treated in accordance with the manufacturers specifications.
32 No curtain, hanging or any other decoration will be positioned so as to obstruct any exit sign or fire fighting equipment.
33 Notices will be prominently displayed in the premises detailing the essential steps that must be taken if a fire is discovered or the fire alarm goes off or other arises and how to call the Fire Service.
34 A person who is nominated for the purpose of taking control in the event of a fire, fire alarm, emergency or event which may effect the safety of persons attending the premises will be on and in charge of the premises at all times when any licensable activity is being provided. That person will be responsible for calling the Fire Service in the event of any fire and that person will also be responsible for meeting the Fire Service and guiding them to the fire.
35 Any outbreak of fire of any kind will be reported to the Fire Service immediately.
36 Clear and unobstructed access will be available to the premises for use by the emergency services and emergency service vehicles at all times.
38 There will be maintained on the premises at all times an adequate and appropriate supply of first aid equipment and materials.
39 When the public are present , lighting levels in all parts of the premises will be capable of providing sufficient illumination for them to leave the premises safely. The lighting level will be maintained by an emergency lighting system which will automatically operate when the electricity supply to the main lighting is interrupted.
40 The premises will be provided with adequate lavatory accomodation which will at all times, when the premises are in use, be kept clean, ventilated, disinfected and supplied with hot and cold water, soap, toilet tissue, hand drying and sanitary towel disposal fascilities as appropriate.
41 No explosive, liquefied petroleum gas or any other highly flamable materials will be used or stored on the premises unless notified to the Licensing Authority and they are used in accordance with any guidance given by Lancashire Fire and Rescue.
42 No pyrotechnics including fireworks will be used or stored at the premises unless notified to the Licensing Authority and they are used in accordance with any guidance given by Lancashire Fire Service.
43 No dry ice machines or cryogenic fog, smoke machines or fog generators will be used at the premises unless notified to the Licensing Authority and they are used in accordance with any guidance given by Lancashire Fire Service.
45 Lasers will only be used on the premises in accordance with the requirements for the safe use of lasers as set down in the HSE Guide, The Safety of Radiation Lasers Used for Display Purposes [HS (G) 95] and BS 60825: Safety of laser products British Standard 4803: part 3
46 No strobe light will be used in the premises unless a notice which can be clearly seen and easily read, warning that strobe lights are in use in the premises, is displayed at each entrance to the premises.
47 Reasonable steps will be taken to encourage customers to leave the premises and the area quietly.
48 A clear, legible and conspicuous notice requesting patrons to avoid causing noise, nuisance or disturbance to local residents shall be displayed the exit from the premises.
49 Refuse such as bottles will be disposed of from the premises at a time when it is not likely to cause a disturbance to residents in the vicinity of the premises.
50 No light from or on the premises and any other light under the control of the premises will be provided where that light causes a nuisance to any nearby premises.
51 There will be in place for the premises a policy to prevent the sale or supply of alcohol to persons under 18 years of age. That policy will require any person who appears to be under the age of 21 years to produce a recognised proof of age card accredited under the Proof of Age Standards Scheme (PASS) or if a proof of age card is not available a photo driving licence or passport indicating that they are over 18 years of age.
52 A notice or notices will be displayed in and at the entrance to the premises where they can be clearly seen and read and will indicate that it is unlawful for persons under 18 to purchase alcohol or for any person to purchase alcohol on behalf of a person under 18 years of age.
53 Accompanied children under 16 will be permitted in the bar area in line with the provisions of the Licensing Act 2003.
