Annex 2 - Conditions consistent with the Operating Schedule
1 The terminal hour for all licensable activities carried out on the premises will be extended by one hour in respect of the following days:
a) Good Friday, Easter Eve, Easter Day, Easter Monday;
b) May Day and the Friday, Saturday and Sunday preceding;
c) Spring Bank Holiday Monday and the Friday, Saturday, Sunday preceding;
d) August Bank Holiday Monday and the Friday, Saturday and Sunday preceding;
e) Christmas Eve, Christmas Day, Boxing Day and when Christmas Day falls on a Saturday or Sunday - the day following Boxing Day;
f) New Year's Day
2 Signs will be maintained in the lounge bar indicating that there will be no further sales or supply of alcohol to non-residents after 2330, or 0030 on specified public holidays.
3 From 2330 or 0030 on specified public holidays, there will be no further sale or supply of alcohol in the lounge bar except to residents of the hotel and their bona fide guests able to establish that they fulfil this definition.
4 At 2330 or 0030 on specified public holidays, the lounge bar will be closed until all members of the public have vacated the premises and there will be no further sales or supply of alcohol until the premises are clear of the general public.
5 The Designated Premises Supervisor and all members of staff will ensure that all lawful instructions and / or directions given by the Police are complied with.
6 The maximum number of persons allowed in the lounge bar will be restricted to 75
7 There will be displayed at the entrance to the Premises a sign, which is clearly visible to those visiting the premises containing details of the hours which the hotel will be open to the public, the licensable activities permitted on the premises and the maximum occupancy level set for the premises.
8 No person in possession of a drink in a sealed or unsealed container will be allowed to enter the premises except for the purposes of delivery.
9 No drink will be removed from the premises in an unsealed container.
10 All parts of the premises will at all times be kept free from defect and no structural changes or alterations on any part of the premises will be made without the prior approval of the Council.
11 All exits and escape routes to the exits (including external escape routes) from the premises will be provided with non-slip even surfaces and will be maintained in good repair, correct working order and kept free from all obstructions when the public are on the premises. External escape routes will also be kept free from ice and snow.
12 All doors or gates both inside and outside the premises which are on an escape route will be fitted only with approved fasteners and will at all times be properly maintained, free from obstruction and be capable of being opened easily and fully so that they do not restrict the public leaving the premises and will open in the direction of the escape route.
13 Where a door on an escape route opens against the direction of exit travel, it will be locked in the open position by a tamper-proof fastening when the premises are in use and there will be a clearly visible notice in capital letters which contains the following words, "THIS DOOR WILL BE KEPT LOCKED IN THE OPEN POSITION WHEN THE PREMISES ARE OCCUPIED" displayed in a clearly visible position next to the door.
14 All exit doors and gates from premises or enclosures surrounding it will be capable of being opened by any person without the use of a key, card, code or other similar means and be kept free from all fastening devices when the premises are open to the public.
15 All exit routes and doors on such routes will be checked at regular intervals when the premises are open to the public to ensure that they are free from defect, obstruction, trip hazards and surfaces are not slippery.
16 The method of opening any exit door or gate from the premises or enclosure(s) surrounding it will be clearly displayed immediately above or below the fastening in white block lettering on a green background in letters not less than 50mm high.
17 Where a fire-resisting door is fitted within the premises and that door is required to be kept closed at all times then the door will be clearly marked on both sides with a sign bearing the words "FIRE DOOR KEEP CLOSED" in block letters not less than 50mm high and clearly visible when the premises are open to the public.
18 Any door or gate in the premises which is not an exit door or gate will have a sign bearing the word "PRIVATE" in block letters not less than 50mm high.
19 Any chain, padlock or any other device used to lock an exit door when the premises are not in use will be numbered and will be removed and stored on a storage hook bearing the same number when the premises are open to the public.
20 The furniture or seating in premises will be arranged so that it does not obstruct any exit, route to any exit or to any facility within the premises.
21 Where any furnishing or fitting in the premises including wall, floor and ceiling linings, requires further periodic treatment to maintain the surface spread of flame qualities, they will be treated in accordance with the manufacturer's specifications.
22 No curtain, hanging or any other decoration will be positioned so as to obstruct any exit, sign or fire fighting equipment.
23 Notices will be prominently displayed in the premises detailing the essential steps that must be taken if a fire is discovered or the fire alarm goes off or other emergency arises and how to call the Fire Service.
24 A person who is nominated for the purpose of taking control in the event of a fire, fire alarm, emergency or event which may effect the safety of persons attending the premises will be on and in charge of the premises at all times when any licensable activity is being provided. That person will be responsible for calling the Fire Service in the event of any fire and that person will also be responsible for meeting the Fire Service and guiding them to the fire.
25 Any outbreak of fire of any kind will be reported to the Fire Service immediately.
26 Clear and unobstructed access will be available to the premises for use by the emergency services and emergency service vehicles at all times.
27 There will be maintained on the premises at all times an adequate and appropriate supply of first aid equipment and materials.
28 When the public are present, the lighting levels in all parts of the premises will be capable of providing sufficient illumination for them to leave the premises safely. The lighting level will be maintained by an emergency lighting system which will automatically operate when the electricity supply to the main lighting is interrupted.
29 Regular inspection of all normal and emergency lighting will take place. All faults discovered will be repaired immediately or if that cannot be done then as soon as is possible.
30 No temporary electrical wiring or distribution system will be installed in the premises unless the installation is carried out by a suitably qualified and competent person. The licence holder will obtain a certificate from that person that the installation is fit for purpose and complies with British Standard 7671 and where applicable, British Standard 7909. A copy of that certificate will be produced by the licence holder if requested to do so by an authorised Officer of the Council or an Officer of Lancashire Constabulary and the Fire Rescue Service.
31 The premises will be provided with adequate lavatory accommodation which will at all times when the premises are in use be kept clean, ventilated, disinfected and supplied with hot and cold water, soap, toilet tissue, hand drying and sanitary towel disposal facilities as appropriate.
32 No explosive, liquefied petroleum gas or any other highly flammable materials will be used or stored on the premises.
33 No pyrotechnics including fireworks will be used or stored at the premises.
34 No dry ice machines or cryogenic fog, smoke machines or fog generators will be used at the premises.
35 No lasers will be used at the premises.
36 Regulated entertainment in the form of music or dance shall be restricted to the bar / function room as identified on the plan.
37 The volume of amplified sound used in connection with entertainment shall at all times be under the control of the management.
38 There shall be no audible noise or perceptible vibration through the fabric of the building or structure to any habitable part of the adjoining property or nearest sensitive premises. (Habitable part means any part of the building or outdoor space in substantial habitable use at the time of the noise but does not include bathrooms, toilets, corridors or access lobbies.)
39 A clear, legible and conspicuous notice requesting patrons to avoid causing noise, nuisance or disturbance to local residents shall be displayed at the exit from the premises.
40 Refuse such as bottles will be disposed of from the premises at a time when it is not likely to cause a disturbance to residents in the vicinity of the premises.
41 No light from or on the premises and any other light under the control of the premises will be provided where that light causes a nuisance to any nearby premises.
42 The Licence holder is to support and rigorously enforce the Challenger 21 proof of age policy. Any person who looks or appears to be under the age of 21 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification acceptable:
i. UK photo driving licence
ii. Passport
iii. Proof of Age Standards Scheme Card
43 A notice or notices will be displayed in and at the entrance to the premises where they can be clearly seen and read and will indicate that it is unlawful for persons under 18 to purchase alcohol or for any person to purchase alcohol on behalf of a person under 18 years of age.
44 Accompanied children under 16 will be permitted in the bar in line with the provisions of the Licensing Act 2003.
45 The primary purpose of the premises operation will be as a hotel providing residential accommodation and ancillary facilities for hotel residents.
46 Sale of alcohol to members of the general public shall be restricted to persons permanently or temporarily resident in a premise on Barton Avenue, Blackpool.
47 Any risk assessments carried out by or on behalf of the licence holder, which relate to a licensing objective, will be available for inspection by a Police Officer or 'Authorised Person'.
48 The premises will be operated in accordance with the general principles of the local 'Nightsafe' initiative, as far as they are relevant to the nature of the operation of the premises.
49 Another member of staff, whose identity is known to other staff, will act on behalf of the Designated Premises Supervisor for purposes of liaison, in their absence.
50 Adequate provisions will be made to prevent unauthorised access to the storage of empty bottles.
