Annex 2 - Conditions consistent with the Operating Schedule
"NIGHTSAFE"
The premises licence holder will agree to abide, support and promote the Nightsafe protocol to help prevent alcohol and drug related problems such as anti-social behaviour, crime, disorder, binge drinking and under age drinking. The following policies will be maintained and regular meetings will take place to help improve and develop our policy so we can ensure a safer clubbing environment.
FIRST AID
A designated First Aid Room is adequately supplied and situated on level two foyer, this room is situated between level one and level two dance arena to ensure first aid response can be as quick and efficient as possible. There shall be at least two members of staff (First Aid Trained) on the premises during operational times. First Aid staff will work in conjunction with the CCTV Operations Room with the aid of radios to help maintain a fast and efficient response to incidents which may occur. Basic first aid boxes are situated on all bars, reception, cloak room, cellar, DJ box and office.
RISK ASSESSMENTS
Risk assessments shall be carried out by or on behalf of the licence holder which will relate to a licensing objective and will be available for inspection by an officer or a responsible authority.
STAFF LEVELS
AA) An adequate number of staff will be maintained during operational hours, this is to ensure customer service and safety is available at all times.
AB) A ratio of not less than 1:100 licensed door supervisors / security based on risk assessment will be on duty during operational hours in accordance with the 'NIGHTSAFE' Scheme and agreed by the Police Licensing Unit.
UNDER AGE
(A) Entry to premises (UNDER AGE)
Designated security who supervise entrance and monitor customers entering premises must challenge any person(s) who look under 21 for photographic I.D. as set out in the 'Under 21 prove it scheme' due to the vast amount of fake/counterfeit I.D. cards ready available in today's market. Photographic 'Prove It' cards, passports, and photographic driving licenses are the only acceptable forms of I.D. for these premises. Memberships cards will also be disregarded as prove of age and will no longer be acceptable for entry to the premises, any member of staff who knowingly give access to person(s) under age to these premises will be dismissed immediately.
(B) Within premises (UNDER AGE)
All staff shall receive suitable training in relation to the proof of age scheme (under 21 prove it scheme). Any staff who suspect and/or know of any person/s under age within the premises must inform a member of management / supervisor immediately, failure to do so may result in disciplinary action.
(C) Staff training (Under 21 prove it scheme)
All staff training will be recorded and available for inspection on request.
(D) Ejection (UNDER AGE)
Any person/s found to be under 18 will be escorted from the premises immediately, and any such incident shall be recorded for inspection by appropriate authorities on request.
(E) Teen Disco
Please note that paragraphs A to D above will not of course apply at any time when the premises are being used for events involving persons under the age of 18 years when the sale and supply of alcohol is not taking place and the bar is closed.
CCTV / RADIO-LINK OPERATION
(A) CCTV equipment
The premises are equipped with a closed circuit television system, which is appropriate to its purpose and provided and maintained to the satisfaction of the enforcement Authorities.
(B) Radiolink equipment
The Radio-Link equipment will be 'live' and will be monitored by the CCTV operator or another responsible person while the licensed premises are open for business.
(C) Access
(i) Licensee, Management, appropriate Authorities and the CCTV Operator are the only person/s authorised to enter the CCTV room.
(ii) No unauthorised person/s to be admitted access into CCTV room at any time.
(D) Coverage
The CCTV operator will monitor the premises at all times when premises are open for business and record/log any incidents which may occur.
(E) Tapes / Log Book
All tapes and log books will be maintained and made available at all times for inspection by the Police and other Enforcement Authorities on request. CCTV tapes will be kept for 31 days.
(F) Incident reporting
All incidents must be reported to the CCTV operative immediately to ensure as much coverage as possible can recorded and logged.
(G) Incident reports
All incident reports must be submitted to the CCTV room at the end of each operational night for inspection by management.
(H) Signing on / off
The CCTV / Radiolink operator will sign on/off each operational night with the Local Authority CCTV control room.
(I) Viewing
Management will view all ejections nightly and make a comment in the incident book. Authorities to be given immediate access to view any incident recording at any time during operational hours.
(J) System Breakdown (Report to Local Authority CCTV control room).
The Local Authority CCTV control room will be informed if on any occasion the CCTV and/or radio system is inoperative, and will also be informed when brought back into use.
(K) System Breakdown (Report to Police Licensing Unit)
The police licensing unit shall be notified on any occasion when the CCTV and/or radio system is to be inoperative for a period in excess of one working day and shall receive a certificate from a competent person stating the reason for the system being inoperative and the measures which have been taken to satisfy the licence conditions.
SECURITY
(A) S.I.A.
All security to be S.I.A. approved.
(B) S.I.A. Badges
(i) All security must carry their S.I.A. badge when on duty as set out in the S.I.A. rules and regulations.
(ii) Copies of all the security staff's S.I.A. badges will be kept in the CCTV room.
(C) Reflective Jacket / Armband
Designated door supervisors / security placed at entrance / exit of premises will wear a reflective jacket, tabard, or armband of a design approved by the Lancashire Constabulary.
(D) Incident Reporting
All incidents must be reported to management / CCTV operations room immediately and all incidents to be recorded / logged and kept available for inspection by appropriate authority. All incident reports will be kept for 7 years.
(E) Customer ejection
No person/s to be ejected from premises unless specified by a member of management, only when customer/staff safety is compromised can security eject any person/s without the presence of a manager.
(F) Reasonable force
Only reasonable force to be used when ejecting a person/s from the premises, any staff found to be using unreasonable force will be dismissed immediately.
(J) Entry to Premises (DRUGS)
Designated security will monitor customers entering premises, with a random drug-search policy in place; a clear and visible sign will be displayed to inform customers of this policy and that if any person found to be in possession of non prescription drugs will be reported to the police. (Please refer to Drugs section, paragraph A)
(H) Designated Search Room
A designated room will be used for drug-searches with CCTV and audio-sound; all searches will be recorded, logged and available on request to authorised authorities only. It is a condition on entering the premises that customers agree to be searched on request, and any person/s who refuses to be searched will not gain entry to premises. All searches will be made by designated security of the same sex at all times. (Please refer to Drugs - Entry to Premises section paragraph C)
(I) Entry to premises (intoxicated person/s)
Security must challenge any person/s who appear to be under the influence of alcohol or drugs and must ensure they do not gain access to premises under any circumstances.
(J) Customers being ejected from premises
Customers causing annoyance, nuisance or disturbance shall be ejected from the premises via the nearest exit, single females, compliant customers and non-violent customers shall be ejected from the premises via the front exit.
(K) Management scrutiny of ejections from premises and incidents of violence
Comprehensive records will be made of such incidents. These records will be reviewed by the management on a regular basis, the records and reviews shall be made available to the police if requested. Regular monthly meetings will take place between the police and management to address any issues of concern.
SALE OF BEVERAGES
(A) Licensee on premises
At least one personal licence holder will be available on the licensed premises during operational hours (while the supply or sale of alcohol is being undertaken), staff will be aware of duty licensee/manager on each operational night.
(B) Toughened glass
Only toughened glass vessels will be used to dispense beverages on these premises.
(C) Designated Supervisor
The Designated Premises Supervisor will nominate a personal licence holder to act on his behalf during any absence; all staff will be informed on any such occasions.
(D) INTOXICATED PERSON/S
All staff must refuse service of intoxicating drinks to anyone who appears to be drunk, or to the companion of a drunken person for the drunken person's consumption.

We will subscribe to the drinks promotions agreement under nightsafe to help stop Binge-Drinking and other drinking related issues.

DRUGS
(A) Staff training (drug taking)
All staff to be trained in what to look for and how to identify customers who have taken drugs and how to identify drug dealers, this training will be carried out by a reputable organisation such as Drugsline.
Staff who suspect any person/s to be in possession of non prescription drug/s must inform security/management immediately.
If any person/s is found to be in possession of drugs the following procedure is put into action:
(i) Substances will be confiscated
(ii) Substances will be logged and locked in drug-safe
(iii) Personal details will be logged in incident book
(iv) If amount is believed to be personal use the person/s will be escorted from the premises
(v) If amount does not warrant personal use the person/s will be held and the appropriate authorities will be informed immediately.
ENTRY TO PREMISES (drugs)
Designated security will monitor customers entering premises, with a random drug-search policy in place; a clear and visible sign will be displayed to inform customers of this policy and that if any person is found to be in possession of non prescription drugs they will be reported to the police.
A designated room will be used for drug-searches with CCTV and audio-sound; all searches will be recorded, logged and available on request to authorised authorities only. It is a condition on entering the premises that customers agree to be searched on request, and any person/s who refuses to be searched will not gain entry to premises. All searches will be made by designated security of the same sex at all times.
(B) Reasonable Suspicion (drugs)
Where there is reasonable suspicion that drugs are being carried, the licensee/management shall ensure that the outer clothing, pockets and bags of those entering the venue are searched by a trained staff member of the same sex.
(C) Searches
All Security to be made aware and trained in the legal side of drug searches, all searches must be carried out in the presence of a licensee and in the designated drug search area, the customer/s consent must be given before any search takes place, all stages of any search must have the consent of the person/s concerned.
Random searches of outer clothing, pockets and bags will also take place on entry to premises if there is reasonable suspicion that drugs are being carried.
(D) Visible notices
Clear visible notices, in a form prescribed by the council, shall be displayed advising those attending that 1. It is a condition of entry that customers agree to be searched and 2. Police will be informed if anyone is found in possession of controlled substances or weapons.
(E) Security arrangements
Sufficient security arrangements will be made to discourage the sale and consumption of drugs and shall ensure such arrangements include regular checks of toilet areas.
(F) Known drug offenders
Any customer known to have been previously convicted of committing criminal offences relating to drugs shall be excluded from the premises.
(G) Incidents involving drugs
Records of incidents involving the use and/or detection of drugs shall be maintained and those records shall be available for inspection.
(H) Confiscated / found drugs
Confiscated and found drugs shall be stored, disposed, transferred in accordance with procedures agreed with Lancashire Constabulary.
(I) Drug prevention
A drugs prevention strategy for the venue shall be developed and applied. The strategy shall include arrangements for the location of posters and the distribution of other information relating to drugs risks, the dangers associated with drugs and the legal provisions relating to drug use. (This will be implemented with the assistance of Drugs/line by December 2005.
(J) Sale / consumption of drugs
A sufficient number of security personnel will be present to discourage the sale and consumption of drugs and regular checks of toilet areas will be made.
(K) Dance & drugs
There will be prominent notices displayed around the premises explaining the effects of various drugs, a description and harm they can cause. A chill-out area and water bar are available for customers located outside level 2 dance arena.
PUBLIC ORDER
DJs and staff on each level will remind customers of the need to leave the premises without causing annoyance, nuisance or disturbance to local residents; a clear visible notice to this effect will be displayed at each exit. Customers will also be reminded of the premises drinking-up time.
EXITS
(A) A clear, legible and conspicuous notice requesting customers to avoid causing noise, nuisance or disturbance to local residents shall be displayed at every exit.
(B) Designated staff will monitor each exit to ensure bottles and glasses do not leave the premises.
HOUSE-KEEPING
All staff to keep designated areas safe and clear at all times, management/supervisors will make frequent checks to ensure empty bottles, glasses and other obstructions are dealt and disposed of as quickly and efficiently as possible, all such checks will be recorded and available for inspection on request, floor staff will also monitor ash-trays, tables, and spillages to ensure public safety.
SOUND LEVEL ASSESSMENT
Sound assessments are made and logged each evening to ensure we stay within the guidelines of Noise at Work and Noise Pollution as set out by B.E.D.A. regarding 1989 Noise at Work Regulations, all controls for amplified sounds within these premises are inaccessible to the public and only authorised staff can gain access.
CAPACITY
The total number of customers entering and leaving the premises will be monitored at all times, a review of capacity will take place every half hour to ensure we do not exceed capacity limits and ensure the safety of customers and staff.
MONITORING OF MOVEMENT
(A) The movement of customers from each level is also monitored, and recorded every half hour, this is to ensure overcrowding does not take place in any one room, and the safety of customers and staff are maintained throughout all areas.
(B) There will be static security and/or stewards monitoring each entrance and exit between levels, each security/steward will have clickers to maintain numbers in/out of each level; these figures will be recorded and given to the CCTV operations room where the capacity of each level is monitored. We as a company believe in the comfort factor as well as customer safety and as a result each level is monitored closely, and the movement of customers from level to level will be restricted when necessary.
PREVENTION OF PUBLIC NUISANCE
The applicant shall employ the services of a reputable sound consultant to undertake a detailed noise assessment, which should then be furnished to the Council's Environmental Protection Division for their comments and recommendations. The assessment shall have regard to any external noise caused by Mechanical Ventilation and / or Refrigeration Plant and detail any works that may be required to attenuate this noise.
Any sound attenuation works should be carried out in accordance with the noise assessment and to the satisfaction of the Head of Environmental Services.
Noise from any Regulated Entertainment shall be inaudible within the nearest sensitive properties or, at the discretion of the Local Authority, shall not exceed some other pre-agreed limit, which does not cause unreasonable disturbance to the residents of these properties or their guests.
All internal doors to any entrance / exit point, fire exit doors and external windows shall be closed during hours of any Regulated Entertainment except in the event of an emergency, save for the purpose of access and egress.
EXTENSION OF HOURS
On no more than 6 occasions per calendar year and following no less than 12 working days written notice to be given to Blackpool Licensing Service and to the Police, the hours for the provision of licensable activities currently provided at the premises may be extended. The time for supply of alcohol must not exceed 0500 hours and the premises must be closed by no later than 0600 hours. On each occasion proposed hours for licensable activities and closure must be agreed with the Police. The Police reserve the right to veto any application should they consider the crime prevention objective would be compromised.
No entry or re-entry to the premises will be permitted after 0230 hours on any occasion when extended licensable hours are approved, provided always, that persons who have left the premises to comply with the smoking ban may re-enter up until 0330 if they have identified themselves as existing customers that evening by use of appropriate technical identification equipment.
BOXING TOURNAMENTS
Admission to the boxing events will be by way of ticket only.
Additional doorstaff will be employed to supervise the boxing events.
Boxing tournaments are limited to four events per annum.
A Doctor or Paramedic is to be on site and an ambulance to be on standby for the duration of the event.
Walkways will be divided by crowd barriers.
All drinks, including bottles, to be dispensed into plastic glasses.
Empty glasses will be removed by staff at regular intervals.
A certified and competent referee will be provided.
Persons under the age of 18 will not be admitted to boxing events, with the exception of competitors participating in boxing events.
BAR HAND VENDING MACHINES
A CCTV camera will be positioned in order to cover the machines.
A permanent member of staff in the CCTV room shall monitor all cameras whilst the club is open.
A dedicated member of staff, 'the supervisor', being the holder of a Personal Licence, shall supervise the sales from the machines at all times in order to be able to deal with customer complaints / enquiries immediately and to seek proof of ID from purchasers of alcohol. The supervisor will prevent sale of alcohol to persons who appear to be drunk.
A door supervisor will regularly patrol the foyer area and work closely with the dedicated member of staff supervising the sale of alcohol from the two vending machines.
During the evening operation only managers will have keys to provide access to the machines. If a customer requires a refund, the supervisor will call for the assistance of a manager.
The supervisor shall always be in possession of a radio. The supervisor will have direct contact with management and doorstaff at all times.
