Annex 2 - Conditions consistent with the Operating Schedule
No intoxicating liquor shall be supplied otherwise than to:
a) A member of the said club who has been a member for at least 2 days or whose nomination for membership was made final at least 2 days before his admission.
b) A guest of such a member bona fide entertained by him at his own expense.
c) Any person not being a club member in accordance with (a) above but who is attending an organised sporting event (namely a soccer or rugby football match) in the capacity of player, reserve player, manager, coach, other auxiliary staff, spectator and a maximum of 2 other persons accompanying each of the above persons. The names and addresses of persons so admitted shall be recorded and kept in a book to remain at the premises.
d) Any person (being a club member) attending a social function organised by or on behalf of a club member and such admission being regulated by an invitation in writing from the organiser.
e) Any person attending a social function organised by or on behalf of a club member for the promotion and benefit of the club and admission to such function being regulated by payment of no less than £1000 either at the door or by purchase of a ticket in advance. The number of such functions to be limited to no more than 12 in a period of 12 months. The Chief Superintendent of Police to be notified in writing 7 days in advance of such functions.
There shall be no off sales.
There shall be rules of the club for the election of members and a copy of such rules and any other rules shall be deposited with the Licensing Authority. Notices of any alterations in any of the rules shall be given to the Licensing Authority within 14 days.
A list of the names and addresses of all members shall be kept on the premises and produced on demand for inspection by a constable in uniform.
All staff to have received suitable training in relation to the proof of age scheme to be applied upon the premises. Records to evidence this will be made available to an authorised officer upon request.
The premises are to be equipped with a closed circuit television system, which is appropriate to its purpose and provided and maintained to the satisfaction of enforcement authorities.
Appropriate measures will be taken to ensure staff prevent the removal of bottles or glasses from the curtilage and grounds of the licensed premises.
At least one personal licence holder is available on the licensed premises while the supply or sale of alcohol is being undertaken (who's identity will be known to all other staff engaged in the supply or sale of alcohol) except in the case of emergency.
Only toughened glass vessels are used to dispense beverages to customers.
The premises are operated in accordance with the principles outlined by the 'Nightsafe' initiative, as are relevant to those premises, and indicated in the associated leaflet.
The premises shall be operated in participation with the 'Pubwatch' and 'Radiolink' schemes.
The licence holder and the DPS shall ensure that the arrangement for the storage of empty bottles prevents unauthorised access to those bottles.
The licence holder and the DPS shall nominate another person who will deputise for the DPS in that person's absence and shall ensure that the identity of the deputy is known by all other staff when such absence occurs.
The licensee and all managers shall produce evidence to demonstrate that they are suitably trained in all aspects of the safe and efficient running of the venue.
The licence holder shall provide and maintain a bottle bin of a type approved by the Local Authority.
The licence holder and the DPS shall maintain a drinks pricing policy which complies with any local authority resolution made in accordance with approval from the Licensees Forum or any successor liaison body recognised by the Licensing Authority.
No patrons shall remain on the licensed premises (except for a period of 30 minutes to enable 'drinking-up') following the termination of licensed activity.
Where there is reasonable suspicion that drugs are being carried, the licensee shall ensure that the outer clothing, pockets and bags of those entering the venue are searched by a trained staff member of the same sex.
The licensee shall exclude any customers known to have been previously convicted of committing criminal offences relating to drugs.
The licensee shall maintain a record of incidents involving the use and / or detection of drugs and make those records available for inspection.
The licence holder shall erect and maintain in a prominent position at every exit a clear and conspicuous notice requesting patrons to avoid causing noise, nuisance or disturbance to local residents.
The Licensee shall ensure that staff arriving before 0900 hours or departing late at night when the business has ceased trading conduct themselves in such a manner to avoid disturbance to nearby residents.
The Licensee shall ensure that noise or vibration shall not emanate from the premises such as to cause persons in the neighbourhood to be disturbed.
The volume of amplified sound used in connection with entertainment shall at all times be under the control of the Licensee or Management.
No explosives, pyrotechnics and fireworks of a similar nature, which could cause disturbance in surrounding areas shall be used, except in connection with 5th November events prior to 2100 hours.
The Licensee shall ensure that cooking, noxious or persistent smells generated at the premises do not cause nuisance to nearby properties, and that the premises shall be adequately ventilated to the satisfaction of the Head of Environmental Services.
The Licence holder and DPS shall ensure that the maximum number of persons allowed onto the premises shall not exceed the capacity determined by the Lancashire Fire and Rescue Service.
Frequent collection of glasses and bottles will be undertaken to ensure that empty containers do not accumulate in or around the licensed premises.
The licensee shall ensure that the ventilation to the premises is maintained to satisfy the appropriate Building Regulations.
Unaccompanied children will not be allowed upon the premises.
The licence holder shall not permit the admission of persons under 18 years of age to the licensed premises whenever a sportsman's dinner is taking place.
No entertainment of an 'adult' or 'sexual' nature will take place upon the licensed premises except when part of a sportsman's dinner is taking place.
Any advertisement for entertainment of an adult or sexual nature will clearly and conspicuously display the words 'Children are not permitted.'
Whenever entertainment of an adult nature is taking place the entertainment will not be visible to person under 18 years of age (including staff) who are within or outside the licensed premises.
Whenever entertainment includes language which could reasonably be regarded as strong or offensive the license holder shall ensure that the entertainment is inaudible to persons within the vicinity and no children shall be upon the premises.
The license holder shall erect and maintain a sufficient number of signs at each bar or alcohol sales point informing customers that sales will not be made to persons under 18 years of age.
Any restrictions imposed by the license holder, DPS and / or the terms of this licence will be prominently and clearly displayed at the entrance(s) to the licensed premises.
