Additional Conditions

• Annex 1 - Mandatory conditions

   

  1              Alcohol shall not be sold or supplied except during permitted hours.  Permitted hours means:

   

  a)              Sunday to Thursday 0900 - midnight

  b)              Friday and Saturday 0900 - 0030

  c)              On New Year’s Eve from the end of permitted hours on New Year’s Eve to the start of permitted hours on the following day (or if there are no permitted hours on the following day, midnight on 31st December)

  d)              Permitted hours on Christmas Eve and Boxing Day shall extend until 0200 the following morning.

  e)              Permitted hours shall be extended by 30 minutes on the Thursday preceding Good Friday and Sundays preceding a Bank Holiday Monday.

  f)              On no more than 12 occasions per calendar year the permitted hours shall extend from 0600 until the beginning of standard hours OR until 0300. These extensions for the supply of alcohol can only take place if at least 7 days notice is provided to the Police and the Licensing Authority and ONLY if the Police give their consent.

   

   

  2              No supply of alcohol may be made under the premises licence -

   

  a)              At a time when there is no designated premises supervisor in respect of the premises licence,

   

  or

   

  b)              At a time when the designated premises supervisor does not hold a personal licence, or his personal licence is suspended.

   

   

  3              Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

   

  4              Any individual employed on the premises to carry out a security activity must be licensed by the Security Industry Authority.

  Annex 2 - Conditions consistent with the Operating Schedule

   

  The rear fire doors to the premises will be kept closed, except for the purposes of emergency, after 2100 hours.

   

  No nuisance from noise or odour will be caused to local residents by the use of ventilation, air conditioning or refrigeration equipment provided or used in association with the licensed premises after 2300.

   

  No light from or on the premises and any other light under the control of the premises shall be provided where the light causes a nuisance to nearby residents after 2300.

   

  The removal of bottles, rubbish, barrels from the premises and the subsequent storage in the rear yard area / associated outbuildings prior to collection shall be undertaken between 0800 and 2000 only to prevent disturbance to local residents from such activities.

   

  The premises are operated in accordance with the principles outlined by the 'Nightsafe' Scheme, as are relevant to those premises, and indicated in the associated leaflet.

   

  The premises shall be operated in participation with the 'Pubwatch' and 'Radiolink' schemes.

   

  Only toughened glass vessels are used to dispense beverages to customers.

   

  Another member of staff shall be nominated to act for the Designated Premises Supervisor, in their absence, whose identity is known by all other staff when such absence occurs.

   

  Records of incidents involving the use and / or detection of drugs shall be maintained and those records shall be available for inspection.

   

  Confiscated and found drugs shall be stored, disposed, transferred in accordance with procedures agreed with the Lancashire Constabulary.

   

  A clear, legible and conspicuous notice requesting patrons to avoid causing noise, nuisance or disturbance to local residents shall be displayed at every exit.

  Annex 3 - Conditions attached after a hearing by the licensing authority

   

  The volume of any amplified background music played incidentally to the regulated activity shall at all times be under the control of the licensee or management and the controlling mechanism shall be operated from a part of the premises inaccessible to the public. Furthermore the noise from the provision of amplified background music shall be inaudible at the nearest sensitive property.

   

  An adequate number of licensed door supervisors will be on duty as appropriate to any risk assessment and in accordance with the guidance under the 'Nightsafe' Scheme.

   

  Appropriate measures will be taken to ensure staff prevent the removal of bottles or glasses from the curtilage and grounds of the licensed premises.

   

  All door staff employed at the entrance / exit of the licensed premises will wear a reflective jacket / tabard of a design approved by the Lancashire Constabulary.

   

  The premises are to be equipped with a closed circuit television system, which is appropriate to its purpose and provided and maintained to the satisfaction of the enforcement authorities.
