Additional Conditions

• Annex 1 - Mandatory conditions

   

  Alcohol

   

  1              No supply of alcohol may be made under the premises licence -

   

  a)              At a time when there is no designated premises supervisor in respect of the premises licence,

   

  or

   

  b)              At a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  2              Every supply of alcohol under the premise licence must be made or authorised by a person who holds a personal licence.

   

  Irresponsible Promotions

   

  1               The responsible person must ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.

   

  2              In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises -

   

  (a) games or other activities which require or encourage, or are designed to require or encourage, individuals to -

  (i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or

  (ii) drink as much alcohol as possible (whether within a time limit or otherwise);

   

  (b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic in a manner which carries a significant risk of undermining a licensing objective;

   

  (c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less in a manner which carries a significant risk of undermining a licensing objective;

   

  (d) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner;

   

  (e) dispensing alcohol directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of disability).

  Free Tap Water

   

  1              The responsible person must ensure that free potable water is provided on request to customers where it is reasonably available.

   

  Age Verification Policy

   

  1               The premises licence holder or club premises certificate holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol.

   

  2               The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy.

   

  3              Subject to sub-paragraph (4), the policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either -

                    

  (a)               a holographic mark, or

                       (b)               an ultraviolet feature.

   

  4              The age verification policy may make provision permitting a responsible person to accept identification in digital form (“relevant ID”) instead of identification of a type described in sub-paragraph (3).

   

  5              Where provision envisaged by sub-paragraph (4) is included in the policy, the policy must make provision dealing with the circumstance described in paragraph (6).

   

  6              The circumstance in this sub-paragraph arises where-

   

  (a)              the responsible person has reason to believe that a person (“P”) who seeks to be supplied with alcohol from a place to which the age verification policy applies has not attained the age of 18, or such greater age as the age verification policy may prescribe (“the relevant age”); and

   

  (b)              P has indicated their wish to use the relevant ID.

   

  7              When the circumstance in paragraph (6) arises, the policy must state-

   

  (a)              that P is obliged, upon the request of the responsible person, to make available to the responsible person the means by which their relevant ID may be verified; but

   

  (b)              that the responsible person may only accept P’s relevant ID where the condition in sub-paragraph (8) applies.

   

  8              The condition in this sub-paragraph is that the responsible person is covered by an agreement with a DVSP (“the relevant DVSP”) for the provision of digital verification services where-

   

  (a)              the relevant DVSP has agreed that it will confirm, in the course of providing its services to the responsible person, whether or not P has attained the relevant age;

   

  (b)              the relevant DVSP has agreed that it will deliver identification to the responsible person that reaches at least a medium level of confidence;

   

  (c)              that level of confidence has been verified by a DVSP, whether that DVSP is the relevant DVSP or another; and

   

  (d)              the relevant DVSP is registered as a provider of those services in accordance with Version 0.4 or Version 1.0 of the DVS trust framework.

   

  9              In this paragraph-

   

  (a)              “DVSP” means a person who provides digital verification services, and is included in the register maintained by the Secretary of State under section 32 (DVS register) of the Data (Use and Access) Act 2025 (“the 2025 Act”);

   

  (b)              “DVS trust framework” is to be construed in accordance with section 28 (DVS trust framework) of the 2025 Act;

   

  (c)              “medium level of confidence”, in respect of identification described in sub-paragraph (8)(b), is to be construed in accordance with-

   

  (i)              Version 0.4 of the DVS trust framework, in the case that the relevant DVSP, or as the case may be, another DVSP provides the service described in sub-paragraph (8)(c), and is registered as a provider of that service, in the DVS register, in accordance with Version 0.4 of the DVS trust framework;

   

  (ii)              Version 1.0 of the DVS trust framework, in the case that the relevant DVSP, or as the case may be, another DVSP provides the service described in sub-paragraph (8)(c), and is registered as a provider of that service, in the DVS register, in accordance with Version 1.0 of the DVS trust framework.

   

  10              For the purposes of sub-paragraph (6) “supplied” is to be construed in accordance with section 14 of the Licensing Act 2003.

   

  11              Nothing in sub-paragraphs (4) to (10) prevents the supply of alcohol to a person based upon identification of a type described in sub-paragraph (3).

   

  Availability of Certain Measures of Alcohol

   

  1               The responsible person must ensure that -

   

  (a) where any of the following alcoholic drinks are sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures -

  (i) beer or cider: ½ pint;

  (ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and

  (iii) still wine in a glass: 125 ml;

   

  (b) these measures are displayed in a menu, price list or other printed material which is available to customers on the premises; and

   

  (d)              where a customer does not in relation to a sale of alcohol specify the quantity of alcohol to be sold, the customer is made aware that these measures are available.

   

  Minimum Pricing

   

  1              A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price.

   

  2              In this condition:-

  a.              “permitted price” is the price found by applying the formula P = D + (D x V), where-

  i.              P is the permitted price,

  ii.              D is the amount of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and

  iii.              V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol;

  b.              “duty” is to be construed in accordance with the Alcoholic Liquor Duties Act 1979;

  c.              “relevant person” means, in relation to premises in respect of which there is in force a premises licence-

  i.              the holder of the premises licence,

  ii.              the designated premises supervisor (if any) in respect of such a licence, or

  iii.              the personal licence holder who makes or authorises a supply of alcohol under such a licence;

  d.              “relevant person” means, in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables the member or officer to prevent the supply in question; and

  e.              “value added tax” means value added tax charged in accordance with the Value Added Tax Act 1994.

   

  3              Where the permitted price would not be a whole number of pennies, the permitted price shall be taken to be the price rounded up to the nearest penny.

   

  4              Where the permitted price on a day (“the first day”) would be different from the permitted price on the next day (“the second day”) as a result of a change to the rate of duty or value added tax, the permitted price which would apply on the first day applies to sales or supplies of alcohol which take place before the expiry of the period of 14 days beginning on the second day.

  Annex 2 - Conditions consistent with the Operating Schedule

   

  1.                            The Premises Licence Holder will conduct 2 audits at the premises per month, one will be pre midnight and the other post-midnight. The items subject of that audit will be as per the inspection               check list to be agreed with Lancashire Constabulary.

   

  2.                            The Premises Licence will retain remote access to the CCTV system in place at the premises and will be able to provide access to any footage with the minimum of delay when requested to               do so by the Police or other relevant authority.

   

  3.                            The Premises Licence Holder or his representative will liaise with the police monthly for at least 6 consecutive months following the grant of any licence to provide feedback on the twice               monthly inspections/audits carried out by them and discuss any concerns or alterations to the operating style the police may have.

   

  4.                            Evidence of severance of the previous lease held between RMS Coastal Resorts Investments ltd and Mathew Crook will be served in writing to the Licensing Authority and the police before               the premises licence takes effect.

   

  5.                The premises shall contain sufficient furniture and seating in order that they do not become a High-Volume Vertical Drinking establishment. Seating must always be available for at least               50% of the permitted capacity on the ground floor.

   

  6.               An authorisation of sales, signed and dated by the DPS, shall be kept at the premises showing all persons authorised by them to make sales of alcohol at the premises. All staff involved in               sales               will be at least 18 years of age and will receive training to promote the licensing objectives, all training to be documented and records made available on request to Lancashire Police               are any authorised officer.

   

  7.              At least two SIA door supervisors to be employed from 21.00 hrs on Friday and Saturday. Should the 1st floor be operated then additional two door supervisors will be employed on these               nights from 21.00hrs until the area on the 1st floor closes with a minimum of one of these to be posted at the exit entry door from Queen Street.

   

  8.              At all other times they shall be employed in accordance with a risk assessment, to be carried out by the DPS. When employed, door staff will wear high visibility armbands. This also               applies to Sundays prior to a bank holiday Monday, Boxing Day, Christmas Eve and New Year’s Eve. At all other times the licence holder will determine an appropriate number of door staff,               having               regard to a risk assessment maintained by the premises licence holder. The document must be available for Inspection if required.

   

  9.              At all times when door staff are on duty or If door supervisors are required following a risk assessment, they will ensure that

                i.Body-worn cameras to be in place for all door staff employed at the premises

                ii.Metal detecting wands/ equipment to be used by door staff

                iii.Ensure that a random search policy is observed whereby approximately 1 in every 7 customers is selected for screening upon entry

   

  10.              A record shall be kept on the premises by the Designated Premises Supervisor of every person employed on the premises as a door supervisor. The record shall contain the following               details:

                i. name, address

                ii. date of birth

                iii. SIA licence number

                              iv. time commenced duty and time terminated duty

   

                That record shall be available for inspection on demand by an authorised person, the SIA or a Police Constable.

   

  11.               The premises will be operated in participation with the 'Pubwatch' scheme.

   

  12.               Recorded music will continue until the time for the sales of alcohol cease. There will then be a further period of 30 minutes when incidental background music only will be played whilst               drinks containers are collected, and patrons gradually dispersed towards the exit.

                Closure of the premises to the public will occur 30 minutes after alcohol sales terminate.

   

  13.               The premises shall be a member of the 'Radio Link' scheme whilst such a scheme is in operation. The Radiolink equipment will be live and monitored by either the head doorman or other              

  14.               An incident book will be maintained, in which shall be recorded:

                a. All incidents of crime and disorder

                b. Refused sales to suspected underage / drunken persons

                c. A record of any person refused admission or asked to leave the premises

                d. Details of occasions upon which the Police are called to the premises

                e. The use or discovery of drugs

                That book shall be available for inspection by a Police Officer or authorised person

  .

  15.               At least one personal licence holder will be available on the premises from 21.00hrs until the premises closes while the supply or sale of alcohol is being undertaken (whose identity will be               known to all other staff engaged in the supply or sale of alcohol) except in the case of an emergency.

   

  16.               All drinks will be served in polycarbonate or other appropriate non - glass vessels on the ground and first floor from 21.00 hours until close each night. At all other times, the use of               polycarbonate will be subject to an ongoing written risk assessment by the current DPS, which will be made available on request for inspection by Police or an authorised person.

   

  17.              There will be a dispersal policy to prevent crime and disorder and to promote public safety.

   

  18.               Appropriate signage alerting customers to CCTV recording shall be displayed in conspicuous positions on the premises.

   

  19.               There will be a zero tolerance drugs policy at the premises.

   

  20.              Entry to the first and second floor will be by the single-entry door on Queen Street only, customers already on the ground floor will not be permitted access to the 1st or 2nd floor via the               interconnecting door on the ground floor.

   

  21.               CCTV must be installed internally and externally at the premises and must comply with the following:

                i) The CCTV system must be installed, maintained and operated to the reasonable satisfaction of Lancashire Constabulary. All public areas of the premises must be covered by the system.               The system will incorporate a camera covering each of the main entrance doors and each camera must be capable of providing an image which is regarded as identification standard in all               lighting conditions.

                ii) The system must record all hours that the premises are open to the public.

                iii) Recordings must display the correct date and time.

                iv) Digital recordings must be held for a minimum period of 28 days.

                v) The system must as a minimum record images of the head and shoulders of all persons entering the premises.

   

  22.              Appropriate signage alerting customers to CCTV recording must be displayed in conspicuous positions on the premises.

   

  23.              A staff member who is conversant with the operation of the CCTV system will be on the premises at all times the premises are open to the public. This staff member will be able to show               police recent data or footage with the absolute minimum of delay when requested.

   

  24.               A dress code policy will be in place at the premises which will be documented, communicated to all staff including any security provider, reviewed annually or at the request of the Police or               Responsible Authority and a truncated version of the policy will be prominently displayed at all customer entrance doors.

   

  25.              The maximum number of customers permitted on any one floor will not exceed 90

   

  26.               No Boxing machines to be installed or used on the premises at any time.

   

  27.               All external doors and windows to any entrance / exit point (to include balcony areas) and any external windows shall be closed by midnight during hours of live entertainment, except in the               event of an emergency, save for the purpose of access and egress.

   

  28.              The collection and disposal of bottles and refuse should not take place externally between the hours of 22.00 and 08.00.

   

  29.               The licence holder shall provide suitable containers for the storage of waste which are constructed and maintained to prevent the removal of such waste by vandal, thieves, animals,               accidental spillage or inclement weather. Any bins containing glass will be kept locked when not in use.

   

  30.               All staff to have received suitable training in relation to the proof of age scheme. Refresher training on underage sales to be provided to all staff every six months. Records to evidence this               will be made available to an authorised officer upon request

   

  31.              No person under the age of 18 to be on the premises after 21.00hrs

   

  32.              Functions which specifically target young people aged 17-18 years (for example birthday parties) will not be allowed to take place on the premises.

   

  33.              Persons who appear to be under the age of 25 years shall be required to produce proof of age by way of one of the following:

                i. A recognised proof of age card accredited under the British Retail Consortium's Proof of Age Standards Scheme (PASS)

                ii. Photo Driving Licence

                iii. Passport

                iv. Citizen Card supported by the Home Office

                v. Official I.D. card issued by HM Forces or European Union bearing a photograph and birth of the holder
