Annex 2 - Conditions consistent with the Operating Schedule
1 The sale or supply of alcohol is ancillary to the provision of table meals or food for the consumption on the premises.
2 The premises are operated in accordance with the principles outlined by the ‘Nightsafe’ Initiative, as are relevant to those premises, and indicated in the associated leaflet.
3 The premises shall be operated in participation with the ‘Pubwatch’ scheme.
4 All staff to have received suitable training in relation to the proof of age scheme to be applied upon the premises. Records to evidence this will be made available to an authorised officer upon request.
Any person who looks or appears to be under the age of 21 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification acceptable: -
i. UK photo driving licence
ii. Passport
iii. Proof of Age Standards Scheme Card
5 An adequate number of Licensed door supervisors will be on duty as appropriate to any risk assessment and in accordance with the guidance under the ‘Nightsafe’ Scheme. At least one door supervisor to be on duty during licensable activities beyond 03.00 hours.
6 Appropriate measures will be taken to ensure staff prevent the removal of bottles or glasses from the curtilage and grounds of the licensed premises.
7 The premises are to be equipped with a closed circuit television system, which is appropriate to its purpose and provided and maintained to the satisfaction of the enforcement Authorities.
8 At least one personal licence holder will be available on the licensed premises while the supply or sale of alcohol is being undertaken (who’s identity will be known to all other staff engaged in the supply or sale of alcohol) except in the case of emergency.
9 Another member of staff shall be nominated to act for the Designated Premises Supervisor, in their absence, whose identity is known by all other staff when such absence occurs.
10 Risk assessments carried out by or on behalf of the Licence holder which relate to a licensing objective will be available for inspection by an officer or a Responsible Authority.
11 During the final hour of daily trading appropriate announcements are made or images are projected to remind patrons of the need to leave the premises without causing annoyance, nuisance or disturbance to local residents and to advise patrons of any taxi free-phone or collection arrangements available upon the premises.
12 The volume of amplified sound used in connection with entertainment shall at all times be under the control of the licensee or management and the controlling mechanism shall be operated from a part of the premises inaccessible to the public.
13 Noise from any Regulated Entertainment, Mechanical Ventilation or Refrigeration Plant shall be inaudible at the nearest noise sensitive premises or, at the discretion of the Local Authority, shall not exceed some other pre-agreed limit, which does not cause unreasonable disturbance to neighbouring residents of these properties or their guests.
14 All external windows doors to any entrance/exit point (to include all balcony areas) and any external windows shall be closed by 00.00 hours during hours of any Regulated Entertainment, except in the event of an emergency, save for the purpose of access and egress. All fire exit doors shall remain closed during Regulated Entertainment except in the event of an emergency, save for the purpose of access and egress.
15 All windows to remain shut during performances of live music.
16 Vibration produced as a result of any Regulated Entertainment shall not be perceptible in any adjoining or nearby sensitive properties.
17 The collection and disposal of bottles and refuse should not take place externally between the hours of 22.00 and 08.00 hours.
18 There shall be placed at all exit points from the premises in a place where they can be seen and easily read by the public, clear and legible notices requiring customers to leave the premises and the area quietly so as to minimise disturbance to nearby residents.
19 The Licence holder shall ensure that adequate ventilation is provided so as to ensure that cooking, noxious or persistent smells generated at the premises do not cause nuisance to properties within close proximity.
20 The Licence holder shall provide suitable containers for the storage of waste, which are constructed and maintained to prevent the removal of such waste by vandals, thieves, animals, accidental spillage or inclement weather.
21 Any external light source associated with the premises shall not cause a nuisance or disturbance to any property within close proximity.
22 The means of escape should be safe, free from any obstruction and checked prior to the public being admitted on the remises. Checks shall be documented and records available for inspection by a Fire Officer, Police Officer or authorised officer of the Council.
23 A Fire Risk assessment to be completed by a competent person and the significant findings made available for inspection by a Fire Officer, Police Officer or authorised officer of the Council.
24 Staff shall receive training in action to be taken in the event of a fire or suspicion of a fire, this shall be recorded and records made available for inspection by a Fire Officer, Police Officer or authorised officer of the Council.
25 Fire alarm to be tested in accordance with BS 5839 part 1 this shall be recorded and records made available for inspection by a Fire Officer, Police Officer or authorised officer of the Council.
26 Emergency lighting to be tested in accordance with BS 5266 this shall be recorded and records made available for inspection by a Fire Officer, Police Officer or authorised officer of the Council.
