Annex 2 - Conditions consistent with the Operating Schedule
1 No entertainment of an adult or sexual nature will take place on the premises.
2 The following non standard timings apply to all licensable activities and the opening hours of the premises:
An additional hour to the standard and non-standard times on the day when British Summertime commences.
New Year's Eve - from the end of permitted hours on New Year's Eve to the start of permitted hours on New Year's Day.
3 At least one personal licence holder will be on the premises while the supply or sale of alcohol is being undertaken (whose identity will be known to all other staff engaged in the supply or sale of alcohol) except in the case of emergency.
4 Another member of staff shall be nominated to act for the DPS in their absence whose identity is known by all staff when such absence occurs.
5 An authorisation, signed and dated by the Designated Premises Supervisor, shall be kept at the premises showing all persons authorised by them to make sales of alcohol at the premises.
6 A zero tolerance drugs policy will be adopted at the premises.
7 Security/staff arrangements will be sufficient to discourage the sale and consumption of drugs and shall ensure such arrangements include regular checks of toilet areas.
8 Where there is reasonable suspicion that drugs are being carried, the licensee shall ensure that the outer clothing, pockets and bags of those entering the venue are searched by a trained staff member of the same sex.
9 Clearly visible notices shall be displayed advising those attending that:
a) It is a condition of entry that customers agree to be searched and
b) Police will be informed if anyone is found in possession of controlled substances or weapons.
10 Records of incidents involving the use, and/or detection of drugs shall be maintained and those records shall be available for inspection.
11 Confiscated and found drugs shall be transferred to the police in accordance with procedures agreed with Lancashire Constabulary.
12 No person in possession of a drink in a sealed or unsealed container will be allowed to enter the premises except for the purposes of delivery or following re-entry from any external area of the premises.
13 Appropriate measures will be taken to ensure staff prevent the removal of bottles or glasses from the curtilage and grounds of the licensed premises.
14 No customers shall be admitted to the premises 1 hour prior to the end of licensable activities. For the avoidance of doubt, this condition shall not apply to those customers who were on the premises prior to the stated times, and who exited the premises for the purpose of smoking.
15 An incident book (which may be electronic) will be maintained in which will be recorded:
All incidents of crime and disorder.
Refused sales to suspected underage and drunken persons.
A record of any person asked to leave the premises or that are removed from the premises.
Details of occasions on which the police are called to the premises.
A record of persons searched on suspicion that drugs are being carried and their reason for such suspicion.
The book will be available for inspection by a police officer.
16 All members of staff shall receive suitable training with regard to serving drunks and are to receive regular refresher training at intervals of a maximum of 6 months, records to evidence this will be made available to authorised officer upon request.
17 Any person within the premises who appears to be intoxicated who is behaving in a disorderly manner will be asked to conduct themselves correctly and if they refuse they will be asked to leave the premises and will be escorted off the premises in a calm and appropriate manner.
18 Frequent collection of drinking vessels will be undertaken to ensure that empty containers do not accumulate in or around the licensed premises.
19 With the exception of bottled beers, bottles of champagne, wine and sparkling wine or jam jars, all alcoholic drinks will be served in polycarbonate or other appropriate non-glass vessels after 22:00 hours on Sunday to Thursday. However, all alcohol drinks will only be served in polycarbonate or other non-glass vessels from 22:00 hours until close on Friday and Saturday and on Sundays preceding Bank Holiday Mondays, Christmas Eve and New Year’s Eve.
At all other times the use of polycarbonate will be subject to a written risk assessment by the current DPS and will be made available for inspection by Police, Relevant Authority or Authorised person.
In relation to a bona fide pre booked private function taking place on the first floor, the use of polycarbonate drinking vessels will be subject to a written risk assessment by the current DPS and will be made available to the Police or an authorised officer of the Council upon request. Where glassware is used during times the Ground Floor is operating with Polycarbonate drinking vessels such glassware shall not be removed from the function room.
20 CCTV must be installed internally and externally at the premises and must comply with the following:
i. Appropriate signage alerting customers to CCTV recording must be displayed in conspicuous positions on the premises.
ii. The CCTV system must be installed, maintained and operated to the reasonable satisfaction of Lancashire Constabulary. All public areas of the premises must be covered by the system. The system will incorporate a camera covering each of the main entrance doors and each camera must be capable of providing an image which is regarded as identification standard in all lighting conditions.
iii. The system must record all hours the premises are open to the public.
iv. Recordings must display the correct date and time.
v. Digital recordings must be held for a minimum period of 28 days. The system must as a minimum record images of the head and shoulders of all persons entering the premises.
vi. CCTV must be available to be viewed within 60 minutes of request from the Police, responsible authorities or an authorised person and provide footage in a viewable format within 48 hours of request, with minimum delay.
vii. The licence holder must notify the Police Licensing Unit on any occasion when the CCTV is to be inoperative for a period in excess of one working day and shall provide a certificate from a competent person stating the reason for the system being inoperative and the measures which have been taken to satisfy the conditions of this licence.
viii. Bi-annually documented maintenance checks by a suitably qualified CCTV engineer must be made of the CCTV system to ensure that the system is in good working order and is operating in compliance with the conditions of this licence.
21 There will be a minimum of 2 SIA registered door supervisors on duty from 21.00 hours every Friday and Saturday, Bank Holiday Sunday, Boxing Day and New Year's Eve and then one door supervisor will be added for every one hundred customers thereafter. On all other opening times an adequate number of licensed door supervisors will be on duty as appropriate to any risk assessment.
22 All door staff shall sign a register when performing duties at the premises. This register is to contain the full names, SIA badge numbers and contact details of that person. Those records are to be made available on request to any relevant authority for the purposes of investigating or preventing crime or apprehending or prosecuting an offender.
23 Adequate first aid provision is available at all times the premises are being operated.
24 The licence holder / DPS shall arrange adequate supervision of any queue which may form to gain entry to the premises.
25 The licence holder shall erect and maintain suitable and sufficient conspicuous signage on the exterior of their premises advising patrons that causing any disturbance or disorder in a queue will result in admission being refused.
26 There will be no persons under the age of eighteen permitted on the premises after 20.00 hours unless they are partaking in a meal or attending a pre-arranged private function. All persons under eighteen must be accompanied by an adult at all times.
27 The premises shall maintain a written dispersal policy which shall be made available to the Police or an authorised officer of the Council upon request.
28 When the premises are open for the sale of alcohol after 3am there shall be no new admittance of customers after 3am. For the avoidance of doubt, this condition shall not apply to those customers who were on the premises prior to 3am, and who have temporarily exited the premises, e.g. to smoke.
29 Where Pubwatch exists covering the area of which the premises is situated then the DPS or other nominated employee shall participate in Pubwatch.
30 If the outside terrace is used as a smoking area there will be a minimum of one SIA registered security staff in this area at all times from 21:00hrs on Mondays, Fridays and Saturdays until the premises is closed. This area is subject to a risk assessment with consideration of further door supervisors.
31 No drinks should be taken onto the outside terrace after 22:00hrs on Mondays, Fridays and Saturdays. All other timings should be subject to a risk assessment.
32 When door staff are on duty an electronic/computerised ID monitoring system should be used at each point of entry.
33 Substantial refreshments to be available on the ground floor until 21:00hrs each day.
34 The maximum number of persons to be accommodated in the premises or in any particular part of the premises as any one time shall be as follows:
Ground Floor 550
First Floor 400
35 Notices will be displayed at the entrance and exits advising customers to leave quietly.
36 The departure of customers from the premises shall be effectively managed by staff who will request patrons to leave quietly and to avoid causing noise, nuisance or disturbance in the area.
37 The volume of amplified sound used in connection with entertainment shall at all times be under the control of the licensee or management and the controlling mechanism shall be operated from a part of the premises inaccessible to the public.
38 Noise generated from any regulated entertainment in the form of live or DJ led recorded music, mechanical ventilation and refrigeration plant shall not be audible at premises within close proximity so as to cause a public nuisance.
39 The collection and disposal of bottles should not take place between the hours of 22:00 and 08:00.
40 A Challenge 25 proof of age policy shall be implemented and adhered to. Any person who looks or appears to be under the age of 25 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification acceptable:
A recognised proof of age scheme accredited under the British Retail Consortiums Proof of Age Standards Scheme (PASS).
Photo driving licence.
Passport.
Official ID card issued by HM Forces or European Union bearing a photograph and date of birth of the holder.
If no suitable identification is provided the sale of alcohol to them will be refused.
41 All staff involved in the sale of alcohol shall receive suitable training in relation to proof of age scheme to be applied upon the premises. All staff receive regular refresher training at intervals of at least 6 months. Records to evidence this will be made available to officers upon request.
42 Suitable signage will be displayed to specify the Challenge 25 policy is in place.
43 The outside terrace is to have a solid balustrade surrounding it of at least 1.5 metres high.
